We've had perfectly legal games here in Hawaii raided. The cases are always thrown out before they make it to court date, but it doesn't stop the police from keeping on trying. I've actually had a vice cop call me about a tournament I was running that the DA and two ADA were playing in and threatened to bust it if I didn't cancel. I told him he was welcome to come on by and embarras himself.

I' ve already proven that without subject matter jurisdiction, aka 'standing', aka 'corpus dilecti', there is no crime. Meaning specifically that playing in a poker game is not crime.

what i got out of the thread:

1.OP doesnt wants to abide by the law, because the law makes no sense.
2.Law does makes sense, but affects the casual poker player in some ways.
3.Popo wanted to get either easy money/easy catch/etc and busted the game.
4.Makes no sense to chase the money back obv.

Any way you can involve an upper level in this case (not even from the us, so i have no idea)? probably wouldnt help much since it would side with the police, but if the department was actually busto and you can prove they went after the money you should be able to make a case?

No rake no problem. Tax man gonna get his taxes no matter what. Rule #1 in life: you can't beat the tax man. Hell, even the Capone got away with murder, theft, bribery, and all sorts of crimes. But in the end he got caught for tax evasion.
