Re: Mike Postle cheating allegations (FAQ in first post)

"all investigations are on hold" is ambiguous language typical of a lawyer and bureaucrat. They are investigating, but how much resources are being put into the investigation and are they going to do anything about it?

Re: Mike Postle cheating allegations (FAQ in first post)

unless they get someone to testify that was in on it it is tough to form a case. i know you can analyze his hands. but no prosecutor and no jury will understand that. it likely isnt worth their time and money to go forward.
one option is to find a lesser one and give them immunity to testify.

if the casino can be shown to have involvement then that can trigger a response.

so basically if the public is not in an uproar then it will slide under the radar. prosecutors think about making names for themselves with high profile cases.

Since there will be no criminal prosecutions there is no need for immunity. No insider confessions are forthcoming. Why would they and remove any chance for future employment?

There are other cases with subject matter far more complicated than poker maths and probabilities that judges and juries have to dive into for an understanding of events. I do doubt anyone outside of poker actually cares tho, but to say learning probability for a court case is not possible is a little much

if one person gets arrested and faces jail time they will talk. Taylor needs to talk, Mike needs to talk, Justin needs to talk. just arrest one of them

give one immunity or only probation and you will find a willing person quickly.
but this is big to the poker public but probably not so to the general public, especially if it isnt an ongoing news item.

This is America, not some Soviet era country behind the iron curtain.

Mel Gibson died on the rack so that we could have freedom. Innocent until proven guilty and all that jazz. Mike Postle committed the perfect crime. They're going to add him to the next Oceans movie Ocean's 14.

Card player reporting Postle filed a motion to dismiss the Civil Case.

Basically, says there is no one hand where anyone can prove damage.

The article is on the cardplayer website and available for all to read.

Problem is the chance of that happening is about the same as the WSOP happening this summer.

Postle is representing himself, without an attorney appearing for him.

Another indication he is good for the $10,000,000.

This will not end well for Postle. Have his assets been frozen during this process?

Can't freeze what now belongs to Reno-area sportsbooks and casinos.

Re: Mike Postle cheating allegations (FAQ in first post)

Be interested in a lawyer's view. He is laying out an interesting defense. Damage can't be proven on any individual hand. Think the plantiff's need to determine how he cheated. Absent that, Postle will simply analyze every single hand in front of a jury that knows nothing about poker. Additionally, he could analyze every single hand where someone made an off variance play on the history of the stream, or the history of all televised poker.
Can get testimony from every player that has ever been on an extended heater. This defense could go on for years.

None of that stuff is relevant in a court room. There won’t be any hand analysis. This will all be decided on factual evidence not opinion or conjecture.

The only evidence against Mike Postle at this point is hand analysis.

almost all the cases the defending lawyer asked for dismissal. that is standard. just a free shot at winning.

Wrong. Give immunity or only a vaccine and you will find many who are willing. Thereby the problem won't have to be big not only to the poker public but also the general public too. Duh!!!

I think he will be just fine representing himself....

Source: https://www.lsnjlaw.org/Courts/NJ-St...e-Witness.aspx

Representing Yourself in Court: How to Cross-Examine (Question) An Opposing Witness.

Important Points to Remember:

* Listen carefully to the witness’s testimony.
* Ask leading questions (ones that suggest the answer within the question and can be answered by simply saying yes or no).
* Use helpful facts to your advantage.
* If the witness has a reason to lie, question the witness about it.
* Impeach the witness if you can present evidence or get answers from the witness that show the witness is lying.
* Ask questions about the most important points if you believe the answers will help you.
* Do not ask too many questions! Stop when you’ve gotten the answers you need.
* Stay confident and keep a poker face.

It got me thinking though, how do you cross examine yourself in court? Do you wear a suit and a wig that are black down one side and white down the other and keep turning one way and the other. That's what I would probably do!

Is that normal when there is a corporate defendant and a defendant without much assets for the person not to have a lawyer? How is that usually handled?

It is unusual to sue someone with no assets.

Re: Mike Postle cheating allegations (FAQ in first post)

That’s really the crux of it imo. Collectibility. I think the plaintiffs might be amenable to working with Postle if he can give them ammo to go against the casino. They’re the real target. Even if Postle has a couple hundred thousand they can go after, that’s nothing.
