I’ll be impressed if it turns out this is all one giant viral marketing campaign for the scarfs.

Gosh who to believe? The guy who kept quite for nearly a year after the JNandez/Upswing split or the guy who immediately started taking shots at the other. Then went on to build a YouTube career off of slandering other people in the poker industry. This is going to be a tough one.

As a Lawyer, I would be curious to see if these "terms" you mention are capable of being enforced, what I can infer is that both drafted a contract without instructing legal assistance. It seems that this case would be extremely difficult to arbitrate but as we have so little information it would be extremely naive for me to comment.

What I can say is that Upswing seems to have acted in bad faith particularly in the way they have dealt with the matter subsequent to JNandez handing in a notice to quit (terminating the contract). It will be interesting to see Doug's response.

What % cut are DP and FN getting from Granny when she sells these scarfs on ebay next week?

The granny who knitted them is certainly a ScarfAce so I can imagine that if she confronted JNandez direct she might say:

"Hey Fernando, say hello to my little friend."
"You want to play games? Okay, I play with you."

You are a PR nightmare. It should be pretty easy for Fernando to prove that he wasn't compensated for the 4 months he discusses. There are so many better ways of dealing with this than "recording a video" which no doubt will be the usual contentless clickbait from your channel.

I dunno about socially ackward, probably just a douche when the cameras aren't on.

Staked live bumhunter that had a winning month on ignition and never beat any tough game pretending he doesn't care about the money

Talks like he is even in the same league as JNandez, who actually crushed the games

Backtracks about all the negative things he said about JNandez, very insecure petty dishonest tail-tucking behavior

How about some honesty instead

By Jnandezpoker partnering with upswing, they should have structured the deal as Upswing IS the affiliate to selling Jnandezpoker products. It is the only main value that Upswing brought to Jnandezpoker IS the marketing. THEN Upswing outsourced the marketing costs to other affiliates and let that cut into Jnandezpoker revenue.

Whole thing is solved by, Jnandez gets $250 a pop. Upswing as the marketer has $750 to work with, if they want to use Upswing and Doug to sell, they get the full $750, if they want to affiliate out in order to make more sales, let that cut into upswing's $750 revenue.

Both sides were fish. Poker players have those know it all attitudes (me included) and probably used a random lawyer rather than a business partnership type lawyer. The fact that they let the "90 days notice" clause into the contract that UPSWING PRESENTED to Jnandez, shows that their lawyer either didn't understand Upswing business model, Or the upswing lawyer just cut and pasted a contract and asked "Hey yall, read the contract right, (of course they didn't) okay lets present this to Jnandez"

Not that it’s my area of legal expertise but courts in general are pretty hesitant to void contracts, even those drafted by amateurs, unless it’s an insanely broad noncompete.

To be clear, the main focus on the video and most important point is - We do not owe him money and these baseless comments that he is owed 90-100k are absurd.

I also talk about the contract as well as some of the errors in his video, but its not really possible for me to write up everything I say in a long video.

After the vid is posted ill answer any reasonable questions about the issue.
