Good pokernews from The Netherlands: the judge has rules against the Dutch state, who argued that pokerstars.eu is located in the Isle of Man - outside the EU - and therefore Dutch pokerstars.eu players need to play 29% taxes.

The Dutch poker players argued that Pokerstars was located in Malta - within EU - and won their case, saving them mllions of € in taxes over the last years.

Dutch tax authorities can still try for cassation in the Dutch high court, so lets not start sucking each other's dicks quite yet

So, a few things:

Where large international companies are based is basically THE core question of tax law

Pokerstars is clearly based in the Isle of man

To then claim that Pokerstars.eu is based on the isle of man isn't exactly creative by the Dutch state

I think it then comes down to pokerstars to show that a large enough part of their pokerstars.eu operations are based out of Malta, and not Isle of man. Like, literally takes place in Malta. Offices, employees, bank accounts, bosses, all of that. It's not about where the company is registered (.eu clearly would be Malta-registered), it's about where the happenings of the company actually take place. Which is seems they managed to show

No probs And it's important to the players due to it being wether the play takes place on a EU-site (Malta based) or non-EU-site (like Isle of man would be) which decides if you have to pay taxes on your play or not!

The Dutch state wants Dutch players to pay taxes on their winnings, so they try to show that .eu is isle of man based. The players and pokerstars don't really want the same thing, so they try to show that it's Malta based. The whole point of opening the pokerstars.eu thing on Malta is, I believe, to let Euro players play without taxation (since getting taxed would largely make people stop playing on pokerstars, so that's the pokerstars incentive to move their operations into .eu and EU territory)

Norway has all but banned online poker and Sweden's new regulations cause some terrible issues. I guess Finland is fine though, but who the ****kkkk wants to move to Finland

The government appealed pro forma a while ago because they had to within 6 weeks of the hearing.
My lawyer told me there's around 50% chance they will retract their appeal, which would mean the case is over.
The tax department will be making their decision in the next few weeks.
