So, a few things:
Where large international companies are based is basically THE core question of tax law
Pokerstars is clearly based in the Isle of man
To then claim that Pokerstars.eu is based on the isle of man isn't exactly creative by the Dutch state
I think it then comes down to pokerstars to show that a large enough part of their pokerstars.eu operations are based out of Malta, and not Isle of man. Like,
literally takes place in Malta. Offices, employees, bank accounts, bosses, all of that. It's not about where the company is registered (.eu clearly would be Malta-registered), it's about where the happenings of the company actually take place. Which is seems they managed to show
