The vast majority of crimes are never proven. People can be smart criminals, hire good lawyers, the law can be busy catching different criminals, etc.
I think the argument that they're not criminals would entail their actions/intentions being so wildly unethical as to be bordering on criminal but not quite there. In which case, I don't care about the distinction. At the end of the day, they kept vast sums, while the players were stiffed, and common sense pointed to at least gross negligence.
Who knows maybe I am just experiencing the Dunning Kreuger effect and they are totally innocent and ethical. It would be baffling. I would never forgive unless they went above and beyond to prove their innocence, admitted bad ethics, then declared bankruptcy, etc.
