Obviously this is correct. However (and I'm not sure this applies to this case and doubt it does) in the commodities case, there were I believe 3 judges that presided over this specific type case for decades and all of them were found guilty of corruption after having rules exclusively in favor of the brokerages for decades. So it can become systemic as is often seen in the 3rd world.
