Not true. Even Blitz's lawyer concedes in the letter that she likely has a strong claim against Penthouse, because they invited her to an unsafe workplace. She will get paid. Maybe not by Blitz, but she will receive money.
Also, remember that this letter's sole intent was to convince her not to sue him, and go after Penthouse instead. Like any good lawyer, he is overstating his client's legal position. It costs him nothing to try to intimidate her, and if it works it's one less headache. Liability laws be what they are, especially in California, there is little chance that if she includes Blitz in the suit that he would walk away unscathed (chances are that his homeowners liability insurance company would take the case over and settle it out of court anyway in order to avoid the risk of a larger award at trial).
In short, the letter is entertaining, but will likely have no impact on her inevitable lawsuit.
