If I’m reading this correctly, this could bring online gambling and potentially poker to many states without legislation. Could underlined because of course there will be challenges, legal drama, etc.

^That's a "whoa" statement, but when you add the rest of the context, meh. Nothing in here says that if this were enacted that tribal land based operations can offer online poker anywhere in the country as long as the servers are on tribal land. The example the proposal seems to come from is specifically about Florida and Seminole, so still involving the state directly. The article also talks more about the big change being any gambling category a state offers, they must negotiate in good faith with tribal entities to offer those same games - again still dependent on what the state offers.

This reads as more the BIA got scolded by the Court of Appeals for not shooting down a compact they determined to be illegal and the BIA is now pushing the issue of "tell me more explicitly what the law is." Very similar to NH Lottery suing the DOJ to clarify the nuances of The Wire Act, but that was two years ago and still no interstate online

New Hampshire won, although the Wire Act had never applied to poker or anything other than sports betting businesses nor to activities by mere players.

The "servers on tribal land" argument was shot down in California in the past as to players who would access those servers from outside tribal lands.

Interestingly, a tribe in Oklahoma once received an online gaming license from the Isle of Man but lacked an ability to capitalize on it. (Their "partner" seemed in my opinon to be all hat and no cattle at the time. )

Did not read the link but the included text about servers on tribal land sounds identical to what the Seminole claimed in Fla about sports book. It did not hold up.

I doubt this has a chance either. Really no different than saying the servers are in a state where the activity is legal so it is legal in another state. Heck, we should just extend it so the servers are in a different country.

Seems like these issues long resolved against your position.

Yeah, it seems little different than sales taxes. If a U.S. citizen buys something online from a website while they are physically present in a state that charges sales tax, they technically have to pay the sales tax (even if the website does not collect it, though most have been pressured to do so).

The physical location of the person matters.

Why would online poker be any different?

Pretty much sums it up as between a State and tribal reservations within a State.,

The same argument, about servers on tribal land ,has been shot down previously,at least twice I know of in California.

Maybe some day people will play interesting variants that aren't solved to death.

Who am I kidding that's never going to happen, kiddies will never give up their solvers and casuals will never play stuff where they can't go "i like my two cards go all-in", I'm sticking to sports betting as well

Weren't the PokerStars / Full Tilt servers originally on Canadian Indian (Kahnawake) territories? How'd that work out?
