Not sure I understand this. Aren't they more likely to sue for a debt, based on a verbal contract, rather than fraud? And even if it was the former, I don't see how accepting part payment of a debt (in the absence of an agreement that it is in full and final settlement) excludes you from exercising your rights to recover the remainder.
If anything, I would have thought the fact Chino made a payment would serve as an acknowledgment by him of his indebtedness.
