What can they really do this time around? The offshore sites are seemingly out of the jurisdiction of the United States. It does seem weird they ban traffic from certain states though. What could those states really do about it?

Congress needs **** off and leave the unregulated industry alone. For the most part it polices itself (in regard to payouts / fairness) by word of mouth and on forums. There are at least 2 sites going for years now that have been paying out reliably. It's unfair for players who don't have regulated options in their state to have options taken away. That is if it's really even possible this time around ... I suspect these sites have done something to insulate themselves from this type of risk given what happened on Black Friday.

If Congress legalizes online gambling in all 50 states, then the unregulated sites will die because Americans won't have a reason to play there. There are plenty of reputable sports betting / casino / online poker companies and some such as PokerStars should be able to get up and running quickly and would be jumping at the opportunity.
