Just spewing here, but I think this can and should be done.

I'd recommend retaining an expert witness to explain ICM. I'd also be careful to qualify said expert in some established mathematical field rather than calling that individual "poker guy expert" or similar.

Pretty sure they have to argue for an even chop as I thought a lot of them did as good or better than they would have using a more logical chop. The ones who got screwed the most likely won't be part of a case because they got back-room deals.

Finding an expert could prove tough. In the stakehorse case an alleged expert witness, although thoroughly knowledgeable, wasn't certified as an expert witness because he hadn't published papers that had been peer reviewed.

I'm not familiar with that case, but how hard can it be to find a reputable mathematician (college or university professor, perhaps) who can be certified as an expert and be willing to explain the concept on a witness stand? Especially since they'll be getting paid for the work.

I think this was his point (if you read the stake-horse thread you'll see that this is the lawyer involved).

Time to settle Borgata.

You just received a tax refund of $88 MILLION from AC!

Time to refund the players.

People who were completely unaffected and are expecting a refund are the worst ever. But, they're all probably huge fish so the money will be dumped straight back into the poker economy.

Its much easier to explain to a jury an equal chop than an ICM chop. Bring in a math expert the opposition buries the expert in math questions and puts the jury to sleep at best and confuses them at worst.

Then you have to explain ICM chops, why that is better than an equal chop, and convince the jury that a player with 27 to go is going to finish in the place they are asking for the winnings for.

Meh, the concept is easy enough for nontechnical folks to understand:

1) More chips should mean a greater chance of winning and should be paid more

2) A guy with 1 chip should be paid more than 27th place, since with 0 chips he would get 27th place money, and there's a chance, albeit small, that he finishes above 27th. Similarly, we shouldn't pay 1st place 1st place money, since there's a reasonable chance he doesn't win.

Once you have buy-in on these concepts, which shouldn't be hard, then you just have to convince them that the math guy isn't crazy and that there's a commonly agreed-upon method in the poker community for determining equity. They don't need to understand the details of the math.

These quotes may have had something to do with the 17 year sentence:

Quote:
Bethea represented himself at trial.

Bethea was previously convicted in 2001 and in 2005 of similar offenses, including placing late bets at roulette tables, and was sentenced to several years in each case.

I'm shocked, SHOCKED to learn that a NJ court ruled in favor of an AC casino without so much as even pretending to review the ruling exonerating them of all wrongdoing.

Stealing from the aristocrats always carries a serious sentence. Eventually it will likely be life at some private prisons they own.

He either paid the full bail, got it modified to the 10% option, or he's no longer in the online databases I checked for some reason.

Could easily envision a State court being willing to modify bail requirements when the feds already have a leash on him...after all, any violation of the fed bond is apt to be a violation of State bond and the feds can sic the Marshal's on him.

Latest update at pokernews:

"According to an Order Setting Conditions of Release, Lusardi has been on conditional release since June 5, 2014".....

"was scheduled to be sentenced on Tuesday, Jan. 6, though his lawyers sought a postponement to allow for further research." .....

"Assistant U.S. Attorney Susan B. Menzer, who is prosecuting Lusardi, did not oppose the motion to extend the deadline, and Senior U.S. District Judge James C. Fox subsequently postponed sentencing until Feb. 17, 2015. That means the poker world will need to wait another month to learn of Lusardi’s ultimate fate. PokerNews will be sure to bring you an update when Lusardi is in fact sentenced. "
