The state opt out is very common I believe someone else smarter can correct me if I am wrong. there might be some consititutional state rights reason for it. However, Like the speed limit opt out or the .08 BA level the federal goverment has its ways to get states not to opt out.
no its not. Plus, and I don't know if this is correct, but some guy in one of the legislation threads answered a question of mine. The question was whether or not this bill would explicitly make offering unregulated online poker illegal. He quoted a section of the bill (I haven't read it yet and IANAL) and indicated that yes it did. Assuming that is correct, you think that is a step in the right direction?
Forget poker challenges in court re skill games, applicability of the wire act, etc. Everyone seems to be forgetting we haven't even exhausted all our legal options yet re the legality of poker. Again, if correct, this bill would certainly take care of all that.
