You said "many cases." This is one case. Spontaneous remission in cancer is a real thing, and this citation most certainly doesn't control for it.

I’m not sure I understand what you’re trying to say here, but it sounds like you repointing out that government regulation doesn’t always internalize externalities, and it can increase costs without any appreciable benefit. To the extent that’s what you’re saying, I agree that that is possible and it happens. I tend to take issue when people come in with the private sector is better at everything perspective, that’s all.
