I’ll find the quotes from admin officials going into Saturday clearly saying ‘we cannot legally extend this ban’. That’s what makes it so clear to me-Biden people obviously knew going into Saturday they had no legal options.
The SCOTUS has overruled its own decisions on more than 300 occasions. In many instances, those decisions were the result of legislatures passing statutes that arguably or indisputably were in direct contravention of existing Supreme Court jurisprudence.
On a great many occasions, state legislatures in anti-abortion states have passed statutes restricting abortion that are not remotely consistent with existing SCOTUS precedent on abortion. Those state legislatures know that the statutes are unconstitutional under existing SCOTUS precedent but they are trying to set up a test case to get the precedent changed.
In most instances, those laws are simply struck by lower courts and the SCOTUS denies cert.
