As acethiest from our private discussions I have been researching this whole situation.

I believe that I have found a way that would "some" players to recieve all of their funds back.

It may even allow "all" players to make a full recovery.

There has been a similar situation recently in Australia where an internet based gaming site closed and retained the players funds.

With a little prompting the players were REFUNDED 100%.

I suggested a number of weeks ago to pursue a course of action and then prompted when it appeared no one had.

This is a life lesson folks,.. I've given advice and been ignored.

It seems people on here would rather wring their hands or moan and cry in their beer rather than taking productive suggestions to heart in order to resolve this situation.

So my research bears out the distinct possibility of full player recovery with a higher likelihood for players who can prove they made a withdrawl request.

WHAT is hopeful news?? Why all the mystery if there is a legitimate approach to take? I hope this mysterious "hopeful news" doesn't involve sending a retainer in advance of knowing what it is?

Talk to acethiest,... there is a way in my opinion to fully recoup balances that was made prior to the formalization of the Liquidator's appointment.

I have a ton of hours invested in the research.

I have no vested interest in the Tusk situation, because unlike the players whose funds are caught , I always do my due diligence before entrusting some internet company with my $$'s.

As for my creds, ask around ,.. some of your poker buds may have been a member of the 9lives poker forum when it was active.

I was the admin of that forum and was an active advocat in routing out the fraudsters and shysters that populate the online poker site owners.

Anyone who was a member of that forum will remember getting their "MELLOW MAIL"

I find it totally unbelievable that a group of individuals with as much money tied up have done exactly nothing to try and recoup their funds.

Its almost as though you all feel that its someone elses responsibility to come in and bail you out.

Over the course of the past few months I have made many posts about my research as it progressed, suggested courses of action or inaction in other cases, ie chasing the police idea, (obvious that no one had read Interpol's mandate) or the fact that there was no criminal action here only civil.

The law in Australia protects the players.

I have read it and understand the appropriate sections.

Certain player's balances should be 100% protected by the law.

Other players who had made a partial withdrawl request should be protected for 100% of the withdrawl request, whilst the remainder would form a portion of the players pool.

And lastly, I believe a case can be made to the appropriate authorities to force the liquidators to recognize the players funds as secured rather than unsecured.

I spent most of my career working the law and by that I mean reading and interpreting it and bending it to my will where possible.

So people read the Interactive Gambling (Player Protection) Act, specifically the sections starting with sec 134.

OR

Hire a good gaming lawyer in Aus, have him do the research for you, assemble the names, players balances and supporting documents to write to the Gov't and come up with a workable strategy, shouldn't cost any more than $15-$20K.

For all you skeptical of mellow that is fine. I have been pretty disgusted with the inactitivty of posters on this board (this includes myself somewhat). But I have neither the legal know how nor the time to take things into my own hands.

I have spoken to mellow off and on. While he may come across as egotistical at times on this board I beleive he is very smart and knowledgble in the industry. Plus he loves to take on any big company/individual if not solely out of pride.

I'm not going to discuss this anymore publically (for those of you asking questions it should be very obv why mellow is so vague, just think abotu it). In all honesty I'm not sure of the plan and only have good ideas of why this is kept quiet. At this point though I have very little to lose and any help is well appreciated.

FTR mellow has been the most helpful poster to me, battlefeild being second.

Again anyone who is serious i suggest messaging him. Messages to me are always welcome although I won;t be able to provide much info as a result of my own ignorance in regards to what must be done.

How likely is this to get us our money back? I have no idea, but at least its something.

I infer from your comments that mellow is an attorney who has solicited your business.

If he had simply come out and said that was what he was looking to do, then I might be a potential client myself.

But the teasing I-know-something-you-don't game playing and his claimed "no vested interest" doesn't sit well with me. The arrogance I can live with.
