While I understand your frustration (or maybe I don't?), I think you should try to get a more balanced perspective. Until we don't get at least SOMETHING from the liquidators, I feel there's little we can do or even think. I've already sent several polite e-mails requesting some sort of report from Sims, but it's like running into a wall. Anyway, it should be coming: I mean, how much more can it take them to come up with some basic information?

You might be right about some of us having given up. I mean at some point spending so much time on it becomes a -EV decision just for the fact that if you look at your hourly, you could just make back the money you lost rather spend 30minutes a day on here being upset and not really getting anywhere (obvious exceptions being people with large 5-6 figure sums stuck or people that lost their entire bankroll). People that have money stuck in the range of 10-25k don't really have the option of getting a lawyer, it might eat up whatever little money we might get back from the liquidation. At the end of the day maybe 5-6 people in this thread have a legitimate interest in hiring a lawyer to look into this.

And sure, you could try to go out and pool all these players with smaller balances and try to hire a lawyer for all of them, and while most of them would probably eagerly give up 10% of their money at stake to guarantee they get their money back, I'm pretty sure a lot less would flip 10% just for the chance.

I am going to the provincial police today now that I am back in town. I strongly urge everyone to go to their state, provincial, or ?county? police station and report this. At the very least this will put large amounts of pressure on Sims, Tusk and even Microgaming.

The police in my country, if they ever came close to understanding the basics of this situation, would laugh so hard their pizza round of the day would get ruined.

Before you run down and report this to the OPP, you just might want to review Canadian Law as it appears to me that you are the lawbreaker ,...not the Tusk Group.

"The International Masters of Gaming Law

INTERNET GAMING: A LOOK AT ONLINE GAMBLING IN CANADA

Michael D. Lipton, Q.C.

June 2002

Canadians are gambling online. Online gambling is illegal in Canada. Despite this fact, it is very difficult to regulate Internet gambling in Canada.,.........

Canadian law allows only the provincial government and some charities to run gambling operations. It is now clear that this law, section 207 of the Criminal Code of Canada (“the Code”), makes it illegal to operate, or place a bet through, an offshore Internet casino. The Code specifically restricts the way in which Internet gambling can be introduced. Provincial governments are permitted to operate computer-based lottery schemes like Internet gambling but they cannot licence others to do so. Further, any province that did wish to offer Internet gambling could not take bets from out of province residents unless that other province allowed it. Finally, any type of gambling on the Internet would have to be legally available in Canada, leaving the most popular type of online gambling – single event sports betting – prohibited."

I actually disagree with mellowman here.

Section 207 only pertains to offshore cruises. There is not even a single mention of online gambling. I really question the aythors motives in this article....

From my understanding online gambling has largely become a provincial issue. There are some thoughts major changes could happen in quebec, but that is all I have heard.

It should also be noted that no one in Canada has ever been prosecuted for playing online poker and I have not read any statements from lawyers saying it is illegal, although I have read statements saying it is not illegal.

The only way I could see any players getting in trouble is if the online casino was being run inside of canada. Otherwise I can't really see them prosecuting you for playing at an online casino in another nation.

I didn't write the article Michael D Lipton Q.C did, and for those who don't know what a Q.C. is ,..it means Queens Council,... a distinction bestowed upon the creme de la creme of the Canadian Jurisprudence system.

And if you read Article 207(3) of the Criminal Code of Canada

"Offence

(3) Every one who, for the purposes of a lottery scheme, does anything that is not authorized by or pursuant to a provision of this section
(a) in the case of the conduct, management or operation of that lottery scheme,

(i) is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years, or

(ii) is guilty of an offence punishable on summary conviction; or

(b) in the case of participating in that lottery scheme, is guilty of an offence punishable on summary conviction.

and Sub (4)

"Definition of “lottery scheme”

(4) In this section, "lottery scheme" means a game or any proposal, scheme, plan, means, device, contrivance or operation described in any of paragraphs 206(1)(a) to (g), whether or not it involves betting, pool selling or a pool system of betting other than
(a) three-card monte, punch board or coin table;

(b) bookmaking, pool selling or the making or recording of bets, including bets made through the agency of a pool or pari-mutuel system, on any race or fight, or on a single sport event or athletic contest; or

(c) for the purposes of paragraphs (1)(b) to (f), a game or proposal, scheme, plan, means, device, contrivance or operation described in any of paragraphs 206(1)(a) to (g) that is operated on or through a computer, video device or slot machine, within the meaning of subsection 198(3), or a dice game."

Section 207.1 deals with the exemption for cruise ships.

So I went to the OPP today and got deferred to the London police department. Talked to the guy for awhile only to get slightly deferred to the RCMP. So now I gotta book an appointment with the RCMP (was told by a guy in the fraud squad at the LPD that if the guy wouldn't deal with me, he would, but would have to end up going through the RCMP anyway so I may as well go directly to the source)

The practice of appointed Queen's Counsel has also fallen into disuse in part of Canada where the two largest provinces, Ontario and Quebec, ceased making appointments in 1985 and 1976 respectively and the federal government ceased the practice in 1993. No substitute distinctions have been implemented in these jurisdictions as it is felt that the practice is a form of political patronage and is best discontinued entirely. However, title holders continue to use the QC postnominals. Appointment of Queen's Counsel continues in other Canadian provinces, including British Columbia (pursuant to the Queen's Counsel Act, R.S.B.C. 1996, c. 393).

I saw a documentary, couple guys went to the goverment and they said they were selling drugs and they wanted to pay their taxes. Even if its illegal the goverment will accept the profit and will keep the documentation confidential.

Extremely weird but true... just ask the goverment of Canada.

I have $2000 in Red Nines. I'm from Brazil and I'm reading this thread since beginning. Me and another players (about 20) from Brazil - who were playing in Red Nines - are with tied hands 'cause we have no internet gambling legislation at all.

We already send all possible proof and emails to Tusk.

If you guys tell me about how can I help, I'll be happy to do it. At now, I'm waiting the thieves give my money back.

OK im ****ed up with this , im a member of a training site which has blocked Absolute and UB hh from working on there converter thats cool. I got this reply tonight that said were going with 2+2 for the cheating scandle there OK there were players cheating there, Like many other sites bots on FTP, multi accounts on stars n party.., OK Why the **** does no one know that they just robbed our money ? Some guys had 100K plus just takin but you still suppor these!! ITS BS !!Is it because of Doylesroom, Eurolinx adds rev??? Comon 2+2 1 RULE FOR KNOWN PEOPLE ANOTHER FOR NOT KNOWN ***** REDICOULAS!!!

OH an i had these private msgs from battlefield, Which is signed up with through rakereduction.com and cardrunners.com got me intouch with them

Quote:
Can you tell me how much money you had tied up in BFP at the time of closure by microgaming \ tusk? We are trying to work out various scenerios in private with players. Obviously we have to wait to see how much if any the liquidators will give the players, THEN we have to wait and see if Micro Gaming will come through at all

After that we are trying to make the players whole..
I answered not its not much but it was my BR

Got this reply

Quote:
Okay.. Like I said, we are trying. We are still here but we have NOTHING to report. We tried to make contact with the liquidators but they would not see us. They have a secured building and would not let us in, in Australia.

At the end of the day, we have to wait to see what happens with them THEN Micro Gaming.
Now that was a few days ago but when DC sent me a mail saying there not processing absolute HH because of the cheating on 2+2 it pissed me off THEY GOT THERE MONEY BACK AND IT WAS PLAYERS CHEATING NOT SITES / PROVIDERS!!. Why are you advertising prima sites? Double standards!!! Doyles room eurolinx! Its BS
