We could be waiting for a while longer...

I've just read the relevant sections of the International Companies Act in Vanuatu http://www.paclii.org/vu/legis/num_act/ica1992246/

Part 12 is relevant to winding-up a company. Section 100 is the most depressing. Part (2) reads:

(2) Notwithstanding Subsection (1)(h), a liquidator shall not, without the permission of the court, carry on for a period in excess of two years the business of a company that is being wound up and dissolved under this Act.

As this is in legislation, the courts cannot force a liquidator to "hurry up" until the liquidation period exceeds two years.

PS. I'm not a lawyer so don't take this as legal advice. I'm probably wrong. Consult a real lawyer.

Yeah, I said somewhere above that I'd sent a bunch of emails asking for confirmation that they got my proof of debt form...never got a reply. Also sent a bunch asking for any updates, didn't hear anything back.

Great to hear this could go to court though.

Amazingly I got a phonecall this morning (was asleep but not yet in REM) from the Liquidators. I was happy that I got a callback so if you really want to talk to them it's still possible.

He told me that they were still waiting for the Proofs of Debts (wow what a surprise) and that there still was no time-frame. After a little bit of talking and saying how lot of people will not send in their POD because they have very little money in their account he told me that they are going to take 1 or 2 more months to allow people to send in their POD. So it looks like there is going to be AT LEAST 2 months of absolutely nothing happening.

I emailed them my stuff and asked for confirmation. They confirmed the next day. Maybe try emailing them again.

I have yet to recieve confirmation also. I sent mine by email and asked for confirmation in it. Then I sent another email a few weeks later and still nothing.

Maybe they would get more POD's if they sent out another e-mail to everyone with accounts saying that they need to fill out the POD's. If they expect that 4 months later people that haven't filled it out yet are going to suddenly send them all in, they are idiots.

I'll be extremely surprised if we hear anything before the end of the year.

Precisely what I was going to say, I'm glad i read your post first. Unless maybe they are also including non-poker-account debtholders.

I'm sure we'd all be appreciative if you nagged them again when you have a chance. You seem to be the sole source of news at the moment!

I still say they don't need the proofs of debt from account holders anyway. They have the full list of who is owed what, and everybody who sends in proof is essentially getting the figure from the same list anyway. They should send emails to everybody acknowledging the account balance at $x and only worry about proofs if people disagree.

FTR I never received a single email from my poker skin. I'm guessing there are many players out there who have no idea that a liquidation is in the process... Many of these skins have already shut down too so contacting players is probably out of the question now unless MGS decided to send out emails.

Like I said before I figure at least 20-30% of active accounts never fill this out.
