You should learn more about Bitcoin. The advantage of being decentralized (the
point really) is that no one can swoop in and take control of the coins (unless you leave them somewhere vulnerabe). If a Bitcoin poker site is leaving their coins where the DOJ can pick them off, they're doing it way wrong.
That said, I don't know who has said "bitcoin poker is immune to the DOJ", so seems like you're talking to a strawman here.
Maybe they could go after a site's domain name, but they might just look silly when they don't come away with any of the assets, and maybe the site reforms elsewhere. You push on a string long enough and people realize who the real criminals are, the DOJ can't just wave a magic wand and have it however they want.
