As a rule of thumb you should simply never put funds in a poker room that doesn't make it clear that its player funds are held in trust.
In which poker sites are the funds helt in trust and which are not helding the money in trust? Is it possible to find this valuable information anywhere?

I am UK Lawyer (corporate/banking) and have done a bit of insolvency.

IF the funds are held in trust they should come out of the liquidation first, in priority to all other creditors. If not - they will come out more or less last (after secured creditors, taxes, employee debts and liquidator's fees and alongside all other trade creditors) and if there is any significant level of insolvency you can usually forget about getting anything much back.
.
Thanks for your insights Excession. I think your knowledge of such things can help shed some light here..

it doesnt seem logical to me that in the somewhat unique case where a company is a "holding" place for funds (players) that this money would be used to pay their creditors as if it was working capital used to run the business, etc. I'll reference an analogy someone made earlier when saying it's like an armored truck delivering cash that runs over a pedestrian and uses the funds in the truck to pay to for pedestrians hospital bills. People wouldnt really go for that and it doesnt seem like it would hold up in a legal system (that isn't corrupt). If it's not their money, why would it be used to pay their creditors?

wow you have serious issues, quit playing poker b4 you tilt your bankroll away.

oh btw which immature posts? Suggesting to beat the **** out of the owner of tusk isnt immature its probably the most satisfying option available to all of us right now.

Unless you were ofc associated with tusk, which would be the only reason for you to get so pissed at me in first place, time to run from the hordes of angry poker players looking for their money imho.

My main concern right now is that there is no one advocating on behalf of the players with the liquidator. I actually wonder if players even have standing to claim against Tusk's funds - since we never deposited these funds directly with Tusk. If our only claim is against the skins (zero assets, most likely), and then the skins have a claim against MPP, who is in a different jurisdiction than Tusk, basically we're in a huge mess.

This is why I want MGS to step up and say they are advocating for the players. At this point, we don't know if MGS will collect money ahead of players for fees or something that might be owed to them and actually make money while screwing the players.

The players need to get direct access to the liquidator, or the money will all be gone before we even know what's happening. This is what I would suggest guys with 100K+ be looking into. Probably should be an Aussie attorney with experience dealing with Vanuatu offshore corporations.

MLShaff

Once again amazing post.

This is exactly how I feel but you of course put it much better. No one is advocating for the players, if our money came through skins why arn;t the skins going after it for us? I am praying the MGS has grounds to get our account money.

Well That is a great post and i have been talking to lawyerS for a while now. we have couple of problem to resolve first.

Who is holding the money TUSK/ FUZE/ MPP? this is a critical question that have not been answer by anyone. I have email the MGS few times and they are not telling me anything. So we have to figure out who has the money then we can proceed further..

Here is another response by my lawyer once i told him i can not pin point the company that withholds the fund:

"This is the logic. There is no escape from it.
1. You can sue the person who took your money.
2. First, you have to identify who took your money.
3. But, you don't know who took your money; you only know the identity of
some companies that you believe are associated with whoever took your money.
4. You have given money to someone who gave you a false name.
5. Therefore you don't know who you can sue.
5. Therefore you can't sue anyone in Australia.

An analogy. What you have done, is like giving money to someone who called
at your door, saying that they are friends with a known person. You don't
know who it was that you gave your money to, and for all you know they are
broke and living in a park, so there is little point in suing them. If you
try and sue the person that they claim to be friends with, that other person
will win and you will have to pay their legal costs, because it is not them
who owes you the money.

That is your problem. It is a big one. There are various legal tactics
whereby pre trial motions can be begun to try and identify the proper
defendant. The aim would be to try and obtain documents from persons under
subpoena, which hopefully will reveal who the correct party is. If you or
others, want to fund someone to do this, please let me know. But it does
not come cheap. There is a fair bit of work involved and there are no
guarantees. A preliminary Court proceeding like this could cost $10,000."

And as far as the money is being hold in trust or not. The document for GLO external expert report marks teh player purse on balance sheet with * and made a note that fund are hold in trust. But that was may 2006 and god knows what has been happen since then and how reliable is that report.

I am still contemplating what i should do at this point since there is no guarantee to get any money back even after occurring another 10K legal fees. There is no guarantee not to get all the money back by just waiting. I have the contact info of 22 people for the grand total of 385K plus a potential friend of someone who email me and said that he has 650K stuck. Email me FundInTusk@hotmail.com if you wanna join the number.
03-10-2008 , 03:14 PM
Battlefield owner and red9 owner or any other skin owner:

please email me your agreement FundInTusk@hotmail.com with MPP players. (and even MGS /tusk if you have any)

Thanks

I have no association with Tusk. I have a few hundred on Battlefield Poker and I read this thread everyday, hoping on some news on when and how I can get my money back.

I just don't want to read the **** you post because you are an idiot.

Now my last advice to you is: Always let the idiot have the last word in an argument.

My apologies for this BS, but this fool had to be told.

fmohasse-

Seems to me like the way to go about this would be to attack MPP. We can prove a direct link from us, to the skin, to MPP. If MPP is an Aussie company as noted in one of the documents, then the jurisdiction would be Australia rather than Vanuatu. If you can get players with 500K of balances to agree to get this going for 10K, that's only 2% of our balances and I would be interested in putting up 2% of my at risk balance to help fund this.
03-10-2008 , 03:25 PM
fmohasse, you might consider having a lawyer contact MGS, as I imagine that they can answer the questions you need answered.
03-10-2008 , 04:48 PM
One issue bothers me at this point: how are we to "prove" how much the relevant skins owe us? I'm in for 15,000 USD, but what proof do I have of it (particularly when 5,000 USD of those are literally suspended in mid air between Battlefield and Neteller)?

Still here, I read the thread several times per day, all day every day.

I have nothing new I can post public to add (Nothing in writing) so there is no reason for me to post. As stated last time, when I have news, REAL news I will post. Otherwise you can private message me.

All I want to publically state right now is that we are working on this, we are trying to find out who the liquidators are, we are trying to be VERY pro-active behind the scenes.

When I get news, I will post it.
03-10-2008 , 05:52 PM
And the euro-dollar is decreasing every day.. so when this is over my money will be worthless

It already went from 1.48 to 1.54 last week (vs euro)...
Which means I already lost 20K * 0.06 = $1,2K...

I'm wondering how many people have money on these sites and just read everything and don't post here (like I did until this post).

Mostly because I have nothing (new) to say and there is no real point whining to the 2+2's
