lol, I would say the vast majority of lawyers don't have websites. I do not think any in Canada are even allowed. You may find a listing on a website of the many lawyers in a region and how to contact them, but that's about it.

Here are the terms and conditions (from Arctic Poker - probably the same across all Tusk sites). There's really nothing in here that I see that affects us positively or negatively, with the exception of the indemnification which appears to preclude us from suing for loss of use - in other words, if our money is tied up for months we can't say that we are owed extra money because we could have been earning interest on that money, or that we were damaged financially by not having access to that money.

Introduction
These Terms and Conditions are formulated having regard to The Poker Room’s commitment to its customers to provide the highest quality service in a timely, efficient and ethical manner in an environment of steadfast adherence to industry best practice and all regulatory requirements.

By downloading and installing the software, the player is agreeing to these Terms and Conditions.

Registration
It is the responsibility of each Player:

When registering to provide The Poker Room with their true and correct details on the site registration form.


Notify The Poker Room immediately on any change of their registration details.
All Players must be at least 18 years of age to be eligible to register with The Poker Room and play as a Real or Guest user, and to qualify for any prizes. The placement of any bets by minors is an offence. The giving of any false particulars to The Poker Room in relation to age, name and address also constitutes an offence.


The Player agrees that he or she will not allow any other person or third party including, without limitation, any minor, to use or reuse Player's account, access and/or use any materials or information from the Web site, accept any prize, or participate in the Games. The Player is solely responsible for the security of his or her password.


Should the player have any knowledge of any unauthorized usage of the player's account and/or password by someone else the player shall contact The Poker Room immediately to change their password.


The Player further agrees that placing a check-mark in the "Remember Password" option on The Poker Room Logon window when connecting to The Poker Room system, he/she indemnifies and holds harmless The Poker Room against any third person accessing and using the account.
Where minors have access to the Player’s computer, the Player undertakes to install or have installed a Child Protection & Internet Content Filter. The software recommended is provided at: cyberpatrol or Net Nanny

A player found to be registered with an inappropriate or offensive name or, having submitted false or misleading registration details at the Site may be suspended and/or excluded from further play. If the account is suspended The Poker Room at its discretion may close the account permanently and remove it from any such competitions and deny any payments due.

A player agrees to receive any email activity from The Poker Room upon downloading The Poker Room games, unless the player advises otherwise.

A player authorizes The Poker Room to confirm the accuracy of the information they have submitted, at any stage, against government-issued ID.

A player hereby authorizes The Poker Room and designated agents, to conduct any additional verification checks which could assist The Poker Room in confirming the player's identity, age and/or accuracy of information submitted to The Poker Room by the player.

Residents of the following countries are unable to play at The Poker Room - Afghanistan, Albania, Australia, Azerbaijan, Belarus, Croatia, Djibouti, Estonia, Georgia, Hungary, Indonesia, Israel, Kazakhstan, Latvia, Lebanon, Macedonia, Pakistan, Poland, Romania, Russian Federation, Singapore, Taiwan, Turkey and Ukraine.

Jurisdiction
In the event that the ‘Unlawful Internet Gambling Enforcement Act’ is passed in the United States of America, players who play in, or are residents of the following States will have their account locked, or be refused the ability to sign up with this Poker Room :-
Illinois, Indiana, Louisiana, Michigan, Nevada, New Jersey, New York, Oregon, South Dakota, Washington, Wisconsin

Deposits
Due to an increase in fraudulent activity involving Credit Cards, all players who make large deposits using this method will be requested to submit authorisation documents to continue playing. Players will be given 48 hours to comply with this request. After this period, the players account will be locked until these documents are received. Players must submit a copy of the following –

Photo ID
Proof of residency
Copy of front and back of the Credit Card used to make the deposit(s).
Player Limits
A default deposit limit will be imposed on all transactions made via credit card or any variation of debit. This will include a transaction limit, a daily limit and a monthly limit.

Player Information
The Poker Room customer information policy is that any sensitive Player information disclosed by the player to the Poker Room will not be sold or distributed to a third party. Sensitive Information may include: Players full name, Address, Email Address, Date of Birth, Account and credit card details and any details recorded on identification documentation.

When registering in the Poker Room the player accepts that the poker may from time to time communicate certain marketing, promotional, bonus and other associated messages to the player through a variety of mediums including (but not necessarily limited to) email, SMS and/or post. The player will be provided with the opportunity to opt out of further communication in line with the SPAM act associated with the jurisdiction in which they register.

While the Poker Room protects all personal data entrusted to us, we reserve the right to use Players' account numbers as well as their first names in any poker room announcement about promotion results.

Tournaments
Players taking part in the tournament accept the Terms and Conditions and the Prevailing Rules.

The Poker Room will not be held liable for any incorrect information provided by the winning player that may result in a player not receiving their prize.

The Poker Room has the right to withhold any prize from a player if:

If the player's registration details are false or misleading.
There is reason to believe that the result of the game has been affected by an illegal activity.
All winning players will be notified of their tournament result. Prizes may not be awarded until the player has supplied proof of age and current address details have been confirmed.
At any time of a tournament players may be required to provide proof of age and address if requested by the Poker Room. If proof of age or address is not supplied after a formal request by the Poker Room within 7 days that account may be suspended until such proof is provided and the winnings retained.

One account can only win one prize in the same tournament. It is a condition of registration and tournament that all winning participants consent to the publication of their first name and initial of last name, State, Country, and further information in reference to the type of tournament and how they won in various forms of media as requested by the Poker Room.

In the event that a tournament ceases, due to a system failure or any other unforeseen reason the following will occur. The failure will attempt to be remedied prior to the closure of the tournament. The tournament will continue until the scheduled closing date.
No extension to the closing date will occur. In the event that the situation is unable to be remedied prior to the closing date the last record of the players guest account balances will be the official record and winners will be determined according to that list.
The decisions of the Poker Room are final and no correspondence will be entered into.
Employees of the Poker Room are not eligible to participate in any such tournaments.
Players are advised to read the terms and conditions associated with each tournament. The Poker Room reserves the right to limit one entry per person in any such tournament.

Promotions
Any promotions sent out by The Poker Room that does not have specific Terms and Conditions attached are bound by the following Terms and Conditions:

General
In the event of any dispute, the decision of the poker manager will be considered full and final. No correspondence will be entered into.
The Poker Room management reserves the right to change the offer and its terms, including the right to end this offer at any time prior to the expiry date mentioned in the offer.

Player Abuse
The Poker Room reserves the right to refuse or rescind the Bonus for any reason including, but not restricted to, player abuse. The Poker Room reserves the right to bar any persons abusing this promotion from receiving further promotional offers from the Poker Room, as well as the right to pass on any information regarding known abusers to a third party negative database.

Exclusions
A player may request to be excluded from the Poker Room at anytime.

The Poker Room may in its absolute discretion permanently exclude a player from the site, and pay the balance of the players' account to the player.

In the event of a player's death, the balance of the players’ account or any prizes arising from entry into a tournament will automatically form part of the deceased players’ estate. The Poker Room will request the claimant to supply proof of entitlement.

The Poker Room will not be held liable for any incorrect information provided by the Player that may result in a Player not receiving their withdrawn funds.

The Poker Room may place a stop payment on any check that is to be issued to a Player or temporarily place a block on a Player's account if it considers that payment of the check or continuance of the account is affected by suspicious activity illegality or constitutes an offence at law.

The Poker Room has the right to withhold any prize from a Player if it finds that the Player's registration details are false or misleading.

Account Number and Password
It is the responsibility of each player to keep their personal account number and password confidential. The Poker Room is not liable for a player's account that has been used without the authority of the registered user, as a result of disclosing their account number and password, or as a result of inadequate personal computer security.

Winnings

Winnings may be held up to seven (7) days if purchases made to the same account have been processed through Citadel or InstaDebit.
Withdrawals are subject to The Poker Room verification procedures before payment. The Poker Room may charge a nominal fee for check handling.
The Poker Room will, at their discretion, request identification from a player to ensure validity of registration details before withdrawals will be paid.
Withdrawals will be paid back via the purchase method that you have used where possible
Maximum Cash In by any one player is $10,000 per calendar week.
Rakeback
Rakeback and its derivatives are offered by the Poker Room at the Poker Room’s sole discretion and may not be made available to all players. The Rakeback percentage offered in any promotion is neither a fixed nor permanent percentage and the Poker Room may change the percentage paid to any player at the Poker Room's sole discretion without prior warning to any player. If a player's rakeback percentage is modified by the Poker Room any unclaimed Rakeback due to the player will be updated to reflect the new percentage Rakeback offered by that Poker Room.
Rakeback can not be claimed on rake generated by the player prior to the implementation of the Rakeback promotion. Rakeback is based on the accumulation of a player’s rake, and tournament fees (including regular tournaments and Sit’N’Go’s).
Any repudiations, chargebacks or fraudulent actions made in conjunction with a players' account may, at the Poker Rooms sole discretion forfeit any Rakeback that may have been accumulated up until that point in time.

Disputes
Any issues that cannot be resolved by the Poker Room may be forwarded through to the Kahnawake Gaming Commission for their investigation. The Kahnawake Gaming Commissions decision is to be seen as final.

If a claim for a prize or gaming win is made by the claimant before 6 Months after the end of the game, The Poker Room will immediately attempt to resolve the claim.

Site Content
All content on the Site is for personal, non-commercial use only. Players must not use the Site to deal in securities or conduct any business or illegal activity.

Content on the Site is not to be reproduced or distributed without the prior written consent of the Poker Room. The Poker Room own the copyright in all content on the Site.

The Poker Room will use its best endeavours to ensure that the Poker Room software, system network or associated hardware will be error free or uninterrupted. However the Poker Room makes no warranties, express or implied, that the software will be virus free when downloaded by the player and the player has sole responsibility to ensure that he/she has the appropriate products to minimise the risks of any unwanted software affecting the use of the Poker Room software at the point of use of that software.
The Poker Room will use its best endeavours to ensure that the system network or associated hardware (or that provided by 3 rd parties) will be error free or uninterrupted although provides no warranties, express or implied to that effect.

Independent Links

The Poker Room site contains links to other sites not operated by The Poker Room. The Poker Room does not control those sites and cannot be held responsible for their content. Providing such links does not indicate support of any goods, services or content on those sites.
The Poker Room will not be liable to any person for any goods, services or content which may be purchased or accessed through the Site except where supplied by The Poker Room.
Dormant Accounts

A Player's account(s) (Casino and/or Loyalty) that have not been accessed for at least ninety (90) days are considered to be a dormant account(s).

The ninety (90) day period period is counted from the date the player last logged into his or her casino account.
The Casino will notify the account holder by e-mail once the account has been dormant for seventy-five (75) days, advising them that the casino account(s) will soon become dormant. No notification shall be given for a Loyalty account.
The account holder will have fifteen (15) days to access his or her casino account and loyalty account and claim any remaining balance(s).
All dormant accounts are considered closed, and the balance of a Player's account will be removed by the Casino from the casino account. The Player is entitled to apply to have these funds returned to them if application occurs within five years of the date on which the account becomes dormant.

Software Download
The Poker Room cannot and does not guarantee that files available for downloading through the Site will be free of viruses, or other codes that may corrupt or destruct properties. A patron is responsible for implementing sufficient procedures and checkpoints to satisfy particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.
While considerable care has been taken in compiling and updating content on the Site, the Poker Room does not guarantee the accuracy of such content. To the magnitude permitted by law the Poker Room excludes all warranties in relation to the content and is not liable for any damage, loss, cost or expense incurred by any person using the Site.

Depositing funds to their Player's account.

Legal Disclaimer
If you attempt to defraud The Poker Room, in any way, including, without limitation, through the use of credit cards or any other payment method, regardless of the outcome, or if you are found conducting criminal or suspicious activities in any way, then you will be reported.

Suspended Accounts

Indemnification
The player also indemnifies this poker room, its employees, officers, directors and any and all associated or affiliated persons or organizations against any and all costs, expenses, liabilities and damages arising from any legal or other action taken either by or against the player arising from any and all interaction with our poker room and/or any of its employees, officers, directors and any and all associated or affiliated persons or organizations. Such action shall include (but not necessarily be limited to) any actions that might arise as a result of the criminalization of online/Internet wagering within the player's jurisdiction.

The player indemnifies this online poker room, its employees, officers, directors and any and all associated or affiliated persons or organizations against any and all costs, expenses, liabilities and damages arising from any transaction of the player at the Poker Room. Such transactions shall include but not necessarily be limited to the player's:

Entry, use or re-use of this website
Use or re-use of any materials at or obtained from the website
Entry, use or re-use of the Poker Room server
Participation at this online poker room
Acceptance of any prize from this online poker room

The player obtains no rights to this poker room's trade name, specific terms (i.e. the payoff line) or any other terms or materials contained in the website or the software. Foreign Exchange
Normal Exchange Rules will apply to players using credit cards to deposit funds into their player Accounts. The amount charged is dependent on the type of credit card and its particular dealings with Exchange Rates.

Suffice it to say, I have notified the Interactive Gaming Council of my dissatisfaction with both Full Tilt Poker and the Kahnawake. The more I discover, the more shady everything seems. Especially after reading their final report on the Absolute Poker scandal; it's available on their website under News.

Their ruling does nothing to benefit the players; all AP had to do was pay a fine TO THE COMMISSION, pay the costs of THE COMMISSION, put a deposit WITH THE COMMISSION. Very little mention is made of what protections are afforded the PLAYERS.

Yes your situation sucks. Yes it is horrible. However, you need to place your anger properly. Letting it out against innocent posters is unacceptable.

Don't put all your eggs in one basket.

hell even if you played on one of the larger sites like pokerstars / party / Full tilt its probably a good idea to have a healthy portion of your BR offline or split up between various sites.

Hope you guys get your money back, this is scary stuff.

I would like at least one of the skin representatives to reveal ONE thing that their "hard work" has uncovered in this whole situation. What does hard work include exactly?

I have a friend who knows one of the skin owners so when I get in contact with my friend I'm usually ask him if he had heard any news from his friend - the skin owner. Last time I asked my friend he said that he hasn't spoke to the skin owner lately because that guy is two busy nowdays with... playing poker!

I think that anything short of hiring a lawyer and going against microgaming headsup is just a waste of time. Sit back, relax... It's not going to do any good sitting down at tables and chatting with the pokermanager in public, it's not going to do any good whining at the skinowners etc. If they get any information that we should know about, I'm positive they will post it here as soon as they know about it. It's not like microgaming or tusk or whoever will think "ohh, it seems like nobody cares about the money, so we just take it for ourselves". If Microgaming gets word from the liquidator and doesn't act on it, then there might be a point in attacking them and make them understand that they just can't avoid us.

Their hard work ahs uncovered the fact that MGS and Tusk aren't saying anything, what more can you ask of them? They're skin owners, they rely on the information given to them from MGS and Tusk, so far there has been sfa info so what else are they supposed to be doing?

Last time I asked my friend he said that he hasn't spoke to the skin owner lately because that guy is two busy nowdays with... playing poker!
And...? What should they be doing instead? Ringing MGS/Tusk every 15 minutes to have "We've a gag order and can't say anything" every time?

While I understand why a 'Rep' hasn't offered up any information on this I am surprised that someone "in the know" (Like a laid off employee) hasn't created a new 2+2 account & shared what they do know. There has to be plenty of information changing hands internally that would be nice to hear. We would still have to strain the information separating the gossip but it would be interesting none the less.

Sorry to hear this happening to so many of you.
