If so, Hero wins pot, less any uncalled bet (i.e. the flop bet).
If not, Hero didn't protect his action, Villain wins pot. But this would take something really unreasonable on Heroes part, e.g. you can tell he's waiting for villain to muck while dragging the pot before speaking up.
Oh man, that's what I did! In my dream, see, the Villain showed me his hand preflop, and he held K7, which means he flopped two-pair, so I was beat. But then when I saw he was going to muck while I still had cards, I started thinking "oh wow, if I just wait long enough for him to toss his hand irretrievably into the muck, I win!" So I was waiting for that. But then somehow his hand magically changed from K7 to A6, which was very confusing.
In my dream, I yelled for the dealer to call the floor, but she refused because she was actually my ex-girlfriend and, thinking it over, I bet she screwed up on purpose because she wanted me to lose. So I just screamed "FLOOR FLOOR FLOOR" until they came over, but they said "Sorry, nothing we can do, we don't know what cards you had." And I said "But I'm still holding my cards, they're right in front of me!" But they said "sorry, you might have just stolen those from Villain." And then they left, and then I woke up.
