Staking issue with "friend" NEED ADVICE

So last year I was staked by a friend in a $1650 tourney.. I got 2nd for 102k. I had 13k in makeup before the cash. So he gets the 13k in makeup plus half the winnings. He was owed a total of 56k...before paying him his money, i won 8k of the 56k in drunk skiball at a bar one night off him. I payed him 48k in cash. I need to issue a 1099 to him for 44.5k...he is not giving me his social security number and wont cooperate with me for his taxes. What should I do? Sue him? Any serious advice is greatly appreciated
