Unilaterally invoking a 4K contractual penalty for asking for money owed under the contract is a scammer mentality. You point out that Tomas is not a native speaker of English so maybe has chosen the wrong words. I am English, and one of my side jobs is translating Slovak to English. The word he seems to be thinking of is podvodnik, which translates as con man, scam artist, fraudster, scammer. His choice of the correct word is confirmed by me and a large number of other native speakers itt.

Of course if he doesn't have the money he should say so but he has to pay later.

Scam debate aside, its completely idiotic to say that he "received" $8.5k and should have paid taxes on it. He didn't receive **** until he got the check from FT (or from the DOJ on FT's behalf in this case). For all he knew (and what we now know for sure) is that the $8.5k that he "had" on FT didn't even exist! If you sign up for Joe Blow poker site, and they credit your account with $1,000,000 dollars, does that mean you owe taxes on $1 mil? Of course not. Only a fool believes that. The promise that you will receive money in the future is not income, money constructively received is income.

He received 8.5k in cash / pokersite money from OP in 2011, see the OP, thats when he shouldve paid taxes, according to his earnings in 2011. The money received now is not taxable since its completely OPs and can be claimed like that. The additional 4k he scammed from OP is to be taxed again, but thats all hypothetical.

I'm just saying dude should be glad he got paid 12k even if owed 16k. Life lasts a long time. He can try to get it back later without going to court and wasting the money. I wouldn't trash a guy who owes me 16k and pays me 12k. That's just me maybe.

Clearly you have been wronged and the board members have been made aware of this guy. Question is what next, If you have the funds go after him in court. I suspect if he gets the legal documents he will pay up very fast. After a point its not about money but justice. If you can afford it why worry about losing more money than you gain. If you cannot afford it then sleep comfortably in the knowledge that others are now less likely to suffer the same fate.

I've known Zach since he was like 10. I didn't vouch for him, but I would have. He's not a scammer. This is a case of honest miscommunication and/or misunderstanding, not of scamming.

Both parties are dumb to have not spelled things out in a contract though. The purpose of a contract is to make sure both people understand the deal as much as for legal bindingness.

If you've known him all this time and would vouch for him, why didn't you buy his FTP account?

Are you even reading the totally valid points being made here? Your boy, (or you Zach) simply decided to keep 4K because he (or you) is broke. Once he received $8500 from Tomas, he no longer owned the 16K in the FTP account. So to keep 4K of that money is straight up theft. There's no mis-communication. Address the valid points or gtfo.

Along the same lines, there's no argument that "he should be happy he got 12K out of 16K". Him getting a % of what's owed is completely invalid. Tomas owned the $16,000 in the FTP account and Zach stole $4,000 of it, pure and simple. Posting here on 2+2 and discrediting Zach's name is CLEARLY Tomas' last resort, especially when Zach puts in the "non-negotiable" clause.

So what happens when you "receive money upfront" and then don't ship the funds online? Do you then come and blast the "pokerdonks" for giving cash upfront before receiving online funds?

I would take the cash and put it in my pocket...i woyld pull out my laptop and do the transfer while the other party is sitting there. when the transfer went through, we both would leave. i would have the cash and he would have a verified shipment come through.

Yeah see, you are not answering my question. What happens when you put the money in your pocket and then don't pull out your laptop and do the transfer (aka the business model of almost every scam that has ever taken place in the poker world)?

to answer the next question before you ask, if the other party is in thailand or yugoslavia or other foreigner type place, i would not do the transaction unless i got the money first. no ifs ands or buts...just read all the scam threads and you will see why
