A few months ago me and my backers run into some trouble discussed in earlier threads.

Anyway we have run into trouble again.

I took a deal to help them recover make-up. Basically the deal was I play nl50 and 100% of the profit and RB are for the backer. I had to play atleast 20k hands per month and couldnt miss more then 2 months or I would be liable for the MU. In return we cut the MU in half, because the original deal was that if I wanted to quit the stake I would only have to pay half the MU anyway. Basically an atrocious deal for me, but I took it to help them recover the MU. I plan to quit poker pretty much forever after I would be done with this.


Anyway on to the problem at hand. We started the deal half January. I didn't play that much, but nothing was said about it. We just continued on. In feb I played some hands. On the 24th I let them know I was going to re-install my laptop. I played about 11.5k hands after. I showed the graph of the last 5 days at the end of the month and the BR total. I tought I had made the 20k hands, but I didnt re-import the hands to check it exactly. As it turns out now I played ~17k hands. that month. Again nothing was said about this. No hh's requested and graph was accepted and all was good. During this time we made a small profit.

In march things were going well I win a few more buy-ins. Untill disaster happens. The last 2 days of the month every session I play I lose 10 BI. I look at my "this month" graph and as soon as I hit 20k hands I quit and send them the graph. We are now down 8BI from the stake's starting amount.

April comes around and we don't talk much. I am very busy with work. As I was all these months. I work about 70 hours/week. We don't talk untill the 19th of April, before I ask them to send me extra money to continue play. They tell me not to play and some time later they request me my hh's for this year. I promply give them all the hh's and about a week later they tell me I didnt meet the volume goals for Jan-Feb and I am liable for all MU. No discussion possible.

I feel like the backers tried to freeroll me. They continued the stake and let me play thinking it would be their best way to recover MU. As soon as we hit more MU and don't want to continue the stake anymore. They try to dig in the hh's for a way to hold me liable.

I dispute this saying I was never made aware that January was a problem. I recieved no warning and no mention was ever made. If I was aware I was on my last strike I would have been way more careful and double check all my hands.

I also dispute their claim on the basis that we are talking about a missing 3k hands and I have made intentions and effort to honor the agreement and missing 3k hands was unintentional and an honest mistake. In normal business for such a small contractual breach it is common the give an opportunity to compensate. For instance I suggested I would play 5k hands extra in May or June.

There doesnt seem to be any discussion possible. I am being told I am liable for 1545$ and they are only willing to lower the amount if I take a payment plan.

what do you guys think?

i think you have answered your question urself, i don't think they have to keep reminding you everyday what you have agreed to do..

Nah they cant let you play all of march then decide when you lost that jan/feb wasn't good enough.

If your quitting poker tell em to get stuffed and give em zero. Doubt if this went to arbitration they would get much sympathy.
