Yes, assigning your ideas about how such things should be punished to me makes me the idiot. There are other ways to deal with criminal offenses other than jail.

Again, if you feel that the numbers concerning deaths due to second hand smoke are correct, why would you not want to protect those that have no way to stop being exposed to second hand smoke? Do you hate children?
