I'll never forget walking into a second hand game store. (here it's EB Games, like the US' Gamestop) with my brother a number of years ago now and seeing 2k5 on the shelf. I'm all like, "Dude, get this. It's the best football game ever." He said something about liking the new Madden for the 360 and we walked out without it. He had just upgraded to the 360, but still had the old Xbox kicking around.

Then, just recently, I was like, "Yo, do you still have the old Xbox? I want it because I'm gonna buy 2k5 off Amazon." He sold it. He also had NCAA 07 which was a great game that I also wanted to play.

Anyways, that's my long ass story. Good night and have a pleasant tomorrow.

Just checking into say that Twitch is still the worst streaming website. However, I think it also has something to do with my PC. I can watch every other stream site except that one. I've watched entire sporting events and not had a single problem.

Pretty damn gross. This Governor Pence is quickly seeming like more and more of a disaster. I was hoping that the backlash to the House passing the bill might shake him out of signing it, but he didn't seem to reconsider at all.

That was kinda how I thought it felt, like he just rubber stamped it. Really weird on what is essentially a bill that allows for Mass discrimination of any type.

The author of this article is a con law professor at my law school alma mater...I took a couple of the other con law profs but never got around to taking him. In any case, he prefaces his article by saying that he supports gay rights, including gay marriage, and yet he supports the bill: http://www.indystar.com/story/opinio...tion/24477303/

Reading that, and then reading the statutory language, actually makes me think that this may be getting framed politically as worse than it is. I've been guilty of taking the sound bites at face value so far. Guess it will lean heavily on how Indiana courts interpret it.

The title of that article was "Why Indiana needs 'religious freedom' legislation", and after reading it, I have no idea why this bill was necessary. Maybe it's just my being a dolt in the legal realm, but I'm missing something.

For what it's worth, even if it's a blatantly homophobic bill, I don't think it significantly reflects on the state itself. Indiana is a pretty moderate state overall (right-leaning, but not far to the right), and at least where I've lived in Indiana this isn't really reflective of how the citizens feel.

Of course, "where I've lived" doesn't include the various rural areas that are more likely to be stuck in a prior era, so there's a selection bias in what I'm saying.

Eyebooger, I'm fairly confused on this now too. The Indiana statute and the federal statute look to be materially identical.

My guess is that the federal standard may not apply in state court? That doesn't make sense to me either though; I know that I cite case law from federal courts in cases that I litigate in county courts here, and that for instance a Marion County Circuit Court judge will treat 7th circuit opinions as binding case law.

So I guess even I'm unhelpful about exactly why a state would pass an identical law; a state can pass its own standard that somewhat differs from a federal law, but that doesn't seem like what was done here.

Actually, scratch that; the bill creates the ability to create a cause of action, and also creates it as an affirmative defense; that does make sense to me.

You can't just file any claim in a federal court. If you don't have diversity of parties (e.g. me suing you, a Vermont citizen, in Indiana) then it has to reach a dollar threshold in controversy in order to be filed in federal court.

I think that this, for instance, would enable a Muslim to get an injunction in local court against a local governmental entity trying to force him to remove religious headwear, where that in and of itself wouldn't be a valid cause of action before.

So yeah, the more I study this the more I think that Pence is getting killed politically for doing the same exact thing Clinton did, and that this only creates an actual problem if Indiana courts reach conclusions that the state courts elsewhere have not (according to that opinion article by Conkle).
