I know everyone needs to be 100% cashed out by 1AM. I have not been able to confirm start of day times yet, I'd love to open at 7AM on the weekends and holidays if allowed....

"Currently Registered" ?

http://tmsearch.uspto.gov/bin/gate.e...:x86d2x.3.1251

Most of the trademarks for "Cheers" that correspond to CBS or The Bar in Boston in this database have been "Abandoned" or are considered "dead".

Even those abandoned trademarks are not for The WORD Cheers....but instead for various design of trademarks associated with branding of Pretzels, Popcorn, Hot Dogs, Pizza, Candied Nuts, Buffalo Wings, etc....etc....etc.....

The couple that remain active are Trademarks for a Design of "Letters in Stylized Format" and a "Typed Drawing" with the clear example of the graphic Trademark......with design specifics that include;

Design Search Code 26.11.21
- Rectangles that are completely or partially shaded
26.17.01 - Bands, straight; Bars, straight; Lines, straight; Straight line(s), band(s) or bar(s)
26.17.02 - Bands, wavy; Bars, wavy; Lines, wavy; Wavy line(s), band(s) or bar(s)
26.17.13 - Letters or words underlined and/or overlined by one or more strokes or lines; Overlined words or letters; Underlined words or letters

SHAPES-BAR-BANDS Designs with bar, bands or lines
SHAPES-GEOMETRIC Geometric figures and solids including squares, rectangles, quadrilaterals and polygons

In fact, you can clearly see the WORD Cheers being used in MANY, MANY,MANY Trademarks in this database......some for napkins, others for Dixie Cups, some for Cocktail Mixes, but in ALL cases the Trademark is for for the Branded Image tied to a Specific Product, NOT The WORD.

A Cheers Poker Room, in NewHampshire, in no way violates any Trademark currently owned by CBS or anyone else.

Case Closed.

Any further legal advice will require a fee.

Good point. Nice job, everyone!

Tho it helps that we're all on the same side of the issue of "quality card room in Salem NH".

First off, I never said he would categorically get sued. That was someone else. I was just raising this as an issue of concern for Puckster. Whether (and, if so, to what extent) he would feel concern, that was up to him.

While at least some of the registered CHEERS marks do have an "& Design" component to them, the issue is they arguably remain famous and would be more than enough to allow a the trademark holder to pass rule 11 muster in order to launch a suit against a defendant. That alone is a ticket to big money expenditures.

Remember - you don't have to win a suit to get the desired result. My point was and remains the same - Cheers is a good name for a poker room for the exact reason the CHEERS trademark holder could potentially come after Puckster - because it conjures up familiarity, especially given the fact that it will sell alcohol and food.

Also, note that there is a CHEERS themed slot machine (https://www.youtube.com/watch?v=WQokEWWxoO8) that was released within the last couple of years and features characters from the show; and I'm sure it's licensed under the CHEERS trademark(s). So they could claim that the gambling nature of the poker room is confusing and diluting.

Put it this way, if I was the IP lawyer for the CHEERS trademark owner I'd be licking my chops at this.

I think the more valid question here is why the attachment to the name "Cheers"? TBH it's a very meh name, not that I care or it matters really, but why even take the small risk of the trademark owners coming after you? There's a million things you could name it, makes no sense to take a small risk on a name that is bland and generic.

Also, I hope when you say your "poker people" you're not referring to the some of the regs from Rockingham who I saw handing out your business cards. Having degens run your room is the worst decision you could make.

...... professional poker management will be in charge of the room and operation....

lots of the players are friends and associates of mine and are eager to help in any way, that includes handing out cards, etc...

.... I really like the Cheers name... because I'm hoping it has a feel where "you want to go to a place where everyone knows your name"

I travel all around the country playing and researching rooms..... there are so many (larger) rooms than ours that had a great community feel to it, I just loved it.

Did not same old generic name...Full house, ACES .... etc

....... give me a catchy name..

I live west of Nashua and currently travel an hour to visit Seabrook and Hampton Falls. I am very much looking forward to the new room in Salem.

I have also heard rumors that the River Casino is opening a second room in Nashua. Anyone know the facts on that or what their timescale is?

The lime green water would be changed. I included it so you can zoom in snd see all the details...shark cage with a river rat (wearing swimmies), a donkey inside (with 7/2 tattoo) with money as the bait and sharks circling...attached is it with a better color for the water

Any more specifics on opening date? Getting back into the live cash grind and you will be my best option for regular play. Very excited for the room. I'm assuming rake and all that will be the same as the rock?
