Whether this is true or not I don't know, but most on this board identified this very issue when Puck disclosed the name of the poker room last year. It's entirely possible he was hit with a C&D correspondence. That's how these infringement claims usually begin, they wait until the very last minute right before you are about to open and then threaten suit for violation of the Lanham Act and other trademark / service mark laws. If this is true they are probably demanding removal of the Cheers name completely, including the domain name. I have a client right now I am handling a similar infringement matter that was served on him a week before his grand opening.

Personally, I don't like the name Cheers. I would've liked to see something different, but at this point he's come too far to change everything. You have to think after ordering all the chips, felt, signs and other stuff this is going to set Puck back a ton of $$ if in fact true and he's forced to change the name.

Interested to see how this plays out.

I believe everything you say about this subject, this question is not skeptical:

Why would the plaintiff wait until the last minute? Are they more interested in a settlement than in warning the defendant against a problem situation?

EDIT: To be clear, I don't believe for a moment the scandalous rumor posted above about "Cheers has lawsuit"...not if their website is still up! Pokerbeastsu just mentioned that domain names are included in C&D demands.

There are many reasons to wait until the last minute to do a C&D or sue. One it to have there be lots of sunk costs, to maximize leverage/pain. The other is to simply see if they go through with plans. This is exactly why you don't pick names of aggressive brand holders, since at best you hope to have a low enough profile to not get on their radar, and even then spend your existence looking over your shoulder.

As one of those who most vocally cautioned him against the name, I still hope this fate hasn't befallen him, but if it indeed has here's hoping he can somehow still emerge.

Anyways, let's talk about poker returning to Salem,NH...in Chasers & hopefully cheers still.

Do you think the crowds will come back to Salem,NH? I want all the places to thrive. From what each room has posted, they are trying to fill holes that other rooms have had(no table chargers, table shufflers-cheers, bad lighting, uncomfortable chairs, good playing chips, plenty of Tv's for Sports, plenty of space between tables (nothing worse then people constantly bumping into your chair as too many tabke are close together or feeling cramped. I am more for the bigger the table the better 9 handed, with Cup holders built in.

I am sure people want food, soft drinks, red bulls, Hard liquor drinks ,beers (bottle & draft), places to eat(I would suggest offering Food runner service with a fee of course to 99s for Chasers in addition to whatever it may offer).

What type of rake is going to be proposed for Chasers? Cheers?

Will there be must move tables?

Having seen a room basically tank (The River, prime example) being in a bad location after moving from another location with another competitor in town(Nashua Boston Billiards). It seemed like it was set up to fail, not thrive. It was a nice room, just never got going in my opinion and then had to change management and downsize.

Boston Billiards moving the room to a quieter area soon. See how that goes. It took months after it opened to grab people, see if the action remains. It seems to get the most foot track in the door, since there is more than just poker.

Manchester seeming to have lost most of its luster that it grabbed post Rockingham. It seems the tournaments and high hand days are what gets people to show up there. Maybe they can get better seating and better chips and possibly recapture some market share( I don't know of they care). Maybe they can stop reserving/pre-book seating for same special regulars. Everyone pays the same rake....

Hampton Falls, seems to have the #'s on a regular basis for cash games/tournaments and now they have comp system,$0.50/hr

What other rooms are out there in NH? are any of them viable or are they just seasonal/occasional? Keene,Laconia,Rochester?? I've never played them, so I am curious.

I'd love to know what is the true influx of new poker players to any of these venues. Ok would guess mostly 1/2 NL. To me it seems like a majority of the same player pools, mainly for 2/4 NL, just at different locations day to day. Maybe survey or someway to track it. I'm sure it sounds dumb, but that data, if it can be collected should be harnessed by the current and future rooms.

I think 10-12 tables max is the way to go. You want full games, not dead empty space. If offering special tournament, just close cash games for it, otherwise I think it is wasted tables.

As far as other casino games (2 of each (Blackjack & whatecer other games seem plenty and 1 or 2 roulette, to offer something for non-poker players)


All are just my opinions and thoughts....sorry I rambled on so much

My post was simply responding to Samlam's post on 10/22. He could be BSing, but I just responded to address the situation if it is in fact true. To answer the question above, as Rizzeedizzee stated, to maximize leverage and pain. Again if this is all true, it's not like they waited until the last minute, per se, because they're still within the statute of limitations for a Lanham Act claim.

In regards to the Salem, NH poker scene. I am optimistic that the turnout will be great. As of right now there's really no competition. The closest room is 20 miles away in Manchester.

Also, I have to say I really hate the multiple "must move" tables. The way it should be run is there should be only 1 main game with multiple tables acting as must moves. It's stupid to have 3 main games and 1 table feeding those games. Eventually, at the end of the night all the tables break down. That's just my opinion.

Hope its not the case, but naming a business(any business) Cheers is a really, really, really, really bad idea and many people pointed that out.

IANAL but I would think any copyright lawyer would auto-advise you not to do that.

That is your opinion. I don't agree with you that having only one "main game" is a good system. It just makes no sense. How many casinos run a multiple must move system? Zero that I know of. The Rock really ruined the concept for most people. Let the best games thrive and the horrible ones break.

Foxwoods has done it in the past. But when you have a total of 4 2/4NL games and 3 of them are main games that stupid. Makes absolutely no sense. This is how Hampton Falls operates and it's annoying.

A must-move game is for a game that almost never gets more than two tables running. When my room has a "must-must move" game (a third table, players must move to the second table), it is a rare occurance, not a feature. If you're routinely fielding 3-4 tables for a certain game, any must-move is ridiculous.

...but try telling that to folks who think Foxwoods wrote the bible on How to Run a Poker Room.

Made me wonder, "When IS the Wynn scheduled to open?", so I just google'd it: June 2019??? Wow.

Is there many things worse than playing for hours at a table where the average chips stack is 2-4 times the buy-in, and then you get moved to the main the table, and have no grip on how the other 8/9 players are playing that day, and they have 5+ times the average buy-in?

lawsuits and copy write stuff you folks write about is so off the wall it;s barely worth responding too.... Has anyone seen "Cheers" up in... I think Manchester? or googled to see how may businesses are named Cheers across the US.... thousands.

copy write issues come into play when someone advertises and represents themselves as that other copy write business. We do not do that, not even close.

There is no lawsuit, never has been one, and if one ever comes, I will blog and publicize it on every social media for the great exposure it would bring....

I am excited about playing your establishment and other establishments. I am a player and enjoy variety.

I thought the copyright stuff was just starting to run a bad rumor. Glad you addressed it.

I always appreciate all you have posted in the process as well as what others have posted.
