I got a post card a few weeks ago for gold member's for gifts but in ended up in the trash by mistake. Any gold members know the date frame for gift pick up? I think it was 11/13-16 or something like that.

I had a situation come up at approximately 12:40 AM on Thursday, November 6th. Guy opens to $25 and I call and we go heads up to the flop. Guy who opened folds his hand, which is then placed in to the muck pile by the dealer. The hand was literally placed in to the muck pile by the dealer, not simply pushed forward in front of the player. The guy who folded his hand requests his hand back and gets it retrieved from the muck pile by the dealer. I request a floor person and both the dealer and I explain to the floor what happened. I'm then told by the floor person, in these exact words, "the muck isn't a magical pit of death." If the muck isn't a "magical pit of death" then I don't know what the muck is. It's the worst ruling I've ever heard bar none. I should have taken down the floor person's name so all I can say is that he's Asian. I didn't make a big deal about the situation because I probably would have gotten myself banned from the only casino worth playing at. For what it's worth, I would have given the player back his $25 had his hand been mucked because I could tell it was an honest mistake, even though he should be paying attention.

Did he actively fold or were his cards taken from him? Different scenario entirely.

Did player say fold? Did player throw his hand away with a forward motion while aware that he was facing a bet?

If no to both, then the floor does have the discretion to rule the hand live. You say you believe it was an honest mistake - so that leads me to think he didn't realize that you'd bet, which would mean he probably thought he was open checking.

It is my understanding at MDL that you can't really fold if you're not facing action (not a check) and the hand is retrievable. It is the same logic if someone tries to fold their big blind when they could check.

The player pitched his cards in and the dealer placed the cards directly in to the muck pile. It was not simply the player moving his cards forward to the dealer to be mucked. And the guy had no idea I was even in the hand, even though my cards were clearly visible and not covered like a lot of players keep their cards covered at tables. I had position on the guy so I never had a chance to act.

Hold on... did you actually see a flop?

Or did he bet, fold around to you, you called, he didn't realize you called, and then folded before cards came out thinking he'd won the pot?

I was the only caller preflop. Flop came QT8cc.

As it stands, the guy got his hand back and bet $40. I folded my small pocket pair. And no, I don't really care about losing the $25. I just want to make sure this type of thing doesn't happen to anyone in the future. I don't think many people would be able to restrain themselves given this situation.

If the cards were placed on top of the muck by the dealer, then he should get them back. If the cards are thrown into the muck (which is usually the case), then the guy should get a "I'm sorry, but your hand is irretrievable". In either case, the dealer should've stopped him first and said "There's no action to you, check or bet" when he tries to fold. I mean, why is there even a flop if no one called him?

I still don't understand this scenario. Are you saying the dealer dealt the flop and then the other guy just threw his cards into the muck thinking he had won? Why would he think that? If the dealer dealt the flop, then the guy should know there is at least one other player in the hand. And if he checked the flop, why would he think he had won the hand?

Sounds like villain had a brain fart. Hero even acknowledges that he believes villain made an honest mistake.

So... action is on villain, and he's exposed his hand. He accidentally mucked which makes no sense in the scenario except as a cognitive mistake. In the spirit of the game, I'm fine with letting him have his hand back.

And as for hero - you now know EXACTLY what he has, with position. I'd be loving life in that spot myself.
