Getting away with parking illegally a time or two is far different than Encore telling all of their patrons to park their illegally. Encore does not have that right.

If Wynn does care, it would prompt action. If Wynn doesn't care, this would be a path, maybe the only path, to getting poker back in Boston (MGM is already bringing poker back to Springfield).

If you want a referendum that possibly stings the casinos a little more, make it so that, once a poker club opens in a region, the casino in that region can no longer offer it, and then add that, if online gaming becomes a thing, the casinos cannot offer games online that they don't also offer physically.

I think poker was likely profitable for Encore. It was a $25 million/yr business for them before the pandemic. It just wasn't -as- profitable as the other games, making up only 5% of their business. If there were relatively infinite resources (infinite parking, infinite floorspace - e.g., Foxwoods), I think they'd love to have poker. Every Wynn location has been a supporter of poker (pre-pandemic). Plus some poker players don't only play poker. They contribute to the other games and consume events and services.

On the topic of parking and Assembly Row:

GONE-dola: The Link between Somerville and the Encore Will Be a Bridge

Depending on the final design it could be much shorter than the walk from Sullivan, or just a little shorter.

Either way I would expect Assembly Row to further lock down parking if it were open just like they did for commuter parking at the Orange Line.

It's been a long while, but I do remember there being a limit when I went to the movies. I think it might have been like 3 hours free then you had to pay. Definitely had a ticket printed that I had to scan on the way out.

Right - I went to the Pickleball pop-up courts there a few months ago for 5 hours - took the ticket and paid a minimal amount for the parking. Didn't need proof of where I went or for anything to be validated.

Regarding the so-called "Marketplace Lot" (the OG Assembly Place), if you look carefully, there is a sensor embedded in the ground of each parking space. If you park in the same spot there longer than 3 hours, just be aware that it is not without risk.

Right. This is because they aren’t dedicating resources to enforce the private parking as it hasn’t been an issue which is logical.

Any company that owned this property and has corporate tenants contractually expected it to be for their customers is going to protect their legal rights. Once Encore began promoting parking on someone else’s private property (which would never happen but just go with it here) which also violates the leases with the tenants are going to take legal action.

Duh. I expect the vast majority of those parking there are also going to places the spots are for. Also probably those stores and other enterprises normally have adequate parking.

But if hundreds of folks started parking there for hours and hours to go to Encore and this influx began costing those vendors business since their customers lacked parking, you would find this situation very different. The owners would quickly find a way to identify the encroachers and dissuade them

A slap in the face…and an act of bad faith, not just to poker players, but to the licensing authorities and really the whole state. They are practically trolling at this point. The whole aim seems to be build something that is designed to fail, so they can have more of a justification for stopping poker later.
