Actually, they sound like much worse. Accountants.

Apparently they claimed that M8trix/Garden City made essentially zero net profit over the last couple of years. Paid themselves (another corporation) huge fees to license one of the Asian games, for their "Perfect Casino" software, etc.

From what I can see, they are behind the F&B and probably Security.

I would love to see the State dig and find out any ties between them and the "Corporation" at M8trix.

That shouldn't be hard. Remember, the original plans called for the Corporation to have their own office inside the casino.

I used to work for those owners in a different capacity. I'm just going to say that this doesn't surprise me in the least.

Another Article on the situation.

Quint’s allegations suggest the city botched its investigation or simply gave up trying to figure it out.
Hiring Allen Ruby means the owners know they are in deep.

These allegations sound pretty serious. What a web of deceit and misdirection.

Any idea what the final outcome will be?? Fines, suspensions, revoking them and forcing a sale??

From the AG's complaint:

Quote:
Swallow's continued licensure is inimical to public health, safety, and welfare. Swallow is not a person of good character, honesty, and integrity. His prior activities pose a threat to the effective regulation and control of controlled gambling, and create or enhance the dangers of unsuitable, unfair, or illegal practices, methods, and activities in carrying on the business and financial arrangement incidental to the conduct of controlled gambling
Repeated on each "Cause for Discipline". Might be legalese, but clearly indicates that the AG wants Swallow et al out of Garden City.

They are asking for revoking/suspending the license and fining of Garden City Inc, Swallow, the Lunardi's and their Family Living Trust.

My guess would be a deal to have them sell everything to a new owner. The City will push for that because of the taxes they get from the place.

The place won't shut down. Tax revenue, jobs, etc... The last thing the city wants would be a closure.

This isn't the city leveling the charges. It is the state.

Would be interesting to see if Swallow's short attempt at running Hollywood Park Casino drew attention to his "non-standard methods".

Im guessing that Thursday they will give them some sort of short term extension without officially renewing their license. They cant ignore the CA Attorney Generals office, but also cant just shut the casino down. They might get ~ 90 days to respond to the allegations etc.

At some stage the owners will have to decide if they want to fight this all the way or change ownership. Giving up ownership is extreme, but it looks like they did a horrible job of skimming money. They seemed to have left way too many paper trails.

History shows that they will take the stubborn path and then it could get ugly...

Doesn't matter.

It won't close. Change of ownership possible, but the place isn't shutting down.

I think there's a non-zero chance it does get shut down. San Jose will survive it.

So did anything ever happen with this story? Is this place still open?

Still open.

The four-member California Gambling Control Commission voted 3-1 Thursday May 29) to schedule a hearing to gather more evidence before deciding Casino M8trix's fate, delaying a final vote on the embattled card room's license. The regulatory panel indicated a hearing date several months from now would be set Friday (May 30).
No articles stating when the new hearing will be.

The California Gambling Control Commission (who has to re-approve the licenses) is separate from the California Attorney General's Bureau of Gambling Control (who made the claims of wrongdoing).

My guess for a final outcome would be the club stays open with the owners, the GM and the Corporation losing their licenses and a forced sale/receivership.

The NL games are pure action. I couldn't care less about the legal stuff. Players are giving their money away at this place.

Go ahead and close your box, good luck finding games with more fish than this place.

I imagine he meant he was closing his box because the place could get shut down, or that management is shady enough that it is a big risk. I wouldn't want to trust a place like that to keep my money.

It is a shame though; I have never been to the new casino, but I really liked the old Garden City room, much better than Bay 101.

I was at M8trix last night. They had two 10/25 tables going and a board with at least 10 names on it. I played 2/3/5 and that board had 25 names on it.

No news.
I doubt if the State will close them down.
Probably give the owners X amount of time to sell the place.

I doubt it also.

There are 2 separate owners of the casino, doubt they would make them both sell.

I think they would. They probably wouldn't be able to tell that one of the parties was "innocent", so they would want to flush all the old ownership out.

There are technically three owners. Swallow & the two Lunardi's.
And the AG's complaint named all three, although she seemed to come down heavier on Swallow.
Interesting that the charge the AG listed first was that Swallow had a financial interest in the Corporation, which is a big no-no.
