Viffer, as we've already discussed, you asked me what I wanted for payouts, and I said the proportional payouts. That was months ago, and since then no new agreement has been made. I believe I am entitled to keep the payouts this way if I want.
Also, the last time judges were discussed you offered to have David Williams, Tom Dwan, and Billy Baxter be the judges. I agreed, and since then no new agreement has been made.
I wanted to finish the bet in October. This WPT is the last chance we have to finish this bet for months as I will be travelling until the end of February. I have been constantly available, but that won't be the case any more.
As such, I have one last offer for a compromise. I believe I have conceded FAR more than I have received in terms of compromises, and this one is no exception. Quite frankly, if you don't accept this, I'm going into super hard ball mode and I will no longer consider this bet to have any good faith involved. If you say yes, you'll get what you want and the bet will be finished soon.
--------------------------------
The offer:
1) We do winner take all 150k payout with the loser paying any arbitrator expenses (if there are any).
2) You must escrow at least 50k with David Williams, Shaun Deeb, myself, or one of my many friends coming into town to play the 100k on Sunday. I'll have cash in Vegas by Monday at the latest and will be willing to do the same if you want.
3) I get to pick the dates. I will pick two days, and they will both be within 7 days of the WPT ending (Dec 11th). Since this is only a 7 day window, you must be available during the 2 days I choose. We'll set aside a few hours in the afternoon on each day. If there are any days you cannot make, say so now.
4) We stick with the poker player judges - David Williams, Tom Dwan, and Billy Baxter.
If one of those three are unavailable, we will pick a poker player alternate.
If two of those three are unavailable, we will also pick a professional alternate.
If all three are unavailable, we will pick 2 poker player alternates, and 1 professional alternate.
Alternates will be picked as follows:
For Poker player alternates:
A) You may choose anyone from my previously provided long list of names that is available on the dates I choose.
OR
B) You provide me a list of three names that both David Williams and Shaun Deeb agree to be intelligent, honorable, and reasonable professional poker players. They must also not be biased by knowing you much more, liking you much more, or having previously talked to you about the bet or anything pertaining to it. Out of those three, I will pick one. It's on you to make sure they are available.
For professional alternates:
You will provide me a list of three professional arbitrators/mediators available on the dates I will have already chosen in Las Vegas that both David Williams and Shaun Deeb agree appear to be legitimate professionals with acceptable resumes for this bet. Same rules about biases apply, and if you provide multiple names that work for the same firm, they will count as only one.
If you fail to provide me an acceptable list or name from my list, I get to pick any alternate I choose from the list I previously wrote in this thread. This will not go well for you, so don't let that happen.
For reference, here is the list I provided earlier:
