You can track the progress of the discussion at:

http://forum.parttimepoker.com/appea...-appeal-8.html

And he is claiming to have basically nothing, even though he did play $1000 dollar tourney with a full schedule and many $100 dollar heads ups on tuesday of this week.

Last edited by tdomeski; 08-13-2010 at 03:01 AM. Reason: someone playing named Andrew Ferguson, might be a different guy according to PTP

They think its most likely a different Andrew Ferguson. His ip address at ptp was from the US and someone claims to know a different Andrew Ferguson playing in the tourney.

Re: Winning Player Fergwrx WSOP package

Fergwrx:

There is a huge discrepancy in the amount of money you should have and the amount of money you claim to have ($0). Even assuming PTR missed some hands, and you re-bought a few more times in 100r's than normal, and taking into account your admitted $3k cashout you should still have over 5 figures. What gives? Did you owe people money from previous loans and then pay them back with investor funds? It appears (according to the audit posted on PTP) that you actually cashed out $13k. What's up with that? You admitted to cashing out $3k, but clearly $13k is a lot more than $3k and could make up some of this discrepancy.

What I don't understand is why, at this point, are you not being completely upfront about how all the money disappeared? Why are you continuing to skirt around the issue? Why are you taking your sweet time coming up with a detailed debt list? Honestly, how hard can this all be? It's clear your last priority is handling this issue. How can you consider yourself a professional poker player and not handle your business in a timely, efficient manner when you screw your peers over? Communication is your only friend left, utilize it.

i pm'd someone about this asking if he thought it would be alright to post this, he seemed to think it was fine but that it would probably be better if i waited until after the audits, which seemed reasonable, but also said it wouldn't be bad to discuss it. since the discussion is now out there (this is in response to his appeal where he stated funds were lost after his 2nd chance score on the 4th):

even ignoring the WSOP BAP he has he should have ~50-60k online for his online action.

this is his PTR totals since july 4th:

according to this he has lost a total of $28,356 since july 4th

this is his sharkscope for all tournies/sngs across ftp and stars and shows him as up $10,293

this puts him as having lost a documented total of $18,063

even accounting for discrepancies in PTR and SS in documenting games, the margin of error clearly isn't nearly 40k collectively. this doesn't add up at all.
i know there's still the FTP audit to be looked at, but there's still a lot about this that makes little to no sense

Re: Winning Player Fergwrx WSOP package

Well his whole story isn't adding up.

If you look at 7/5 he has barely any money over his 2nd place victory in his stars account. But he should have at least $10k plus the 33k. Well you could definitely argue that perhaps he has 10k in his ftp account. Well if thats the case why does he do 15k in transfers that day. I agree with tdomeski that he clearly had previous debts he had to pay. But this begs the question the 30k he raised for the wsop, did he even cash all that money out? Or did he use some of this to pay off previous debts at the time.

He claimed " acutally didnt even cashout that much as you will see in the audits i used cash i had already for buyins for the most part and money from the $32k cash"

If thats the case than his online account should have more than 33k plus 10k. So again where did that 30k for the wsop go?

He also claimed he only cashed out 3k up unto the point of the audit, but the audit shows 13k cash out. Did he not think we would see that?

Re: Winning Player Fergwrx WSOP package

To all investors: one of the members at part time poker performed an audit of his PS records from July 5th until August 10th. It shows fergwrx having made $13k worth of cashouts and $31k or so worth of player transfers, obviously we have to wait for the Full Tilt audit to figure everything out but this is starting to look really bad.

To fergwrx: obviously you have made a mistake but your lack of communication here considering the amount of $ involved is very troubling, show the investors you let down some respect and at least post a little more regularly in here.

These are the accounts the transfers were sent to, if anyone knows anyone on this list maybe they can get some information as to why the transfer was made?

the FTP audit was posted on PTP. the transfers to metsfan512 check out as swaps. there appears to be 1100 missing with bootswild with the rest being swaps, maroca checks out as a swap. a lot of money has gone to obvaments, a net of $10,336 according to the 2 audits

for reference sake, this is the audit

Re: Winning Player Fergwrx WSOP package

Here's the FTP audit:

I completed a parsing of the FTP Account Audit. Here is a summary:

Net Transfers +$11,676.13 (he ran some BAPs to account for some of this)
Withdrawals ($15,000.00)
Deposits: +$13,450.00
Bonuses: +$1700.00
MTTs & SNGs: +$2484.51
Cash Games: ($14,210.65)

To start the day on July 4th he had $7.29. There was no play on FTP on July 4th (actually no play at all on FTP until sometime on July 5th. at the end of the report on Aug 10th he had $107.28 left in the account and no T$.

Here are some details:

Withdraws:

03-Aug-2010 16:38:30 Debit ($4,500.00)
27-Jul-2010 20:30:03 Withdraw Funds: UseMyWallet ($3,000.00)
05-Jul-2010 04:57:31 Debit ($7,500.00)
($15,000.00)

It looks like the $7500 on Jul 05 is most likely that bootswild gave him FTP money for cash. That withdraw corresponds almost exactly with $7900 received in transfers from bootswild over the 5 hours in between. It was a direct debit so those funds should have gone to his bank account.

The $4500 on Aug 03 somewhat corresponds with some odd transfer activity with gpokerg, but those transfer amounts were for $3500.

Before the $3000 withdraw on Jul 27, he had $3770.67 in his account and left $770.67. One $506 HU SNG was played after the withdraw and no other play until after a the string of transfers with gpokerg and the debit on Aug 03, leaving him $273.47 in the account.

Deposits:

10-Aug-2010 17:53:45 Deposit Funds: Quick Deposit $2,500.00
04-Aug-2010 17:51:41 Deposit Funds: Quick Deposit $2,500.00
03-Aug-2010 17:51:02 Deposit Funds: Quick Deposit $2,500.00
23-Jul-2010 18:57:26 Deposit Funds: UseMyWallet $950.00
22-Jul-2010 17:20:46 Deposit Funds: Quick Deposit $1,500.00
22-Jul-2010 16:33:24 Deposit Funds: Quick Deposit $500.00
22-Jul-2010 16:11:52 Deposit Funds: Quick Deposit $500.00
21-Jul-2010 16:45:22 Deposit Funds: Quick Deposit $1,500.00
21-Jul-2010 16:17:34 Deposit Funds: Quick Deposit $500.00
21-Jul-2010 15:53:59 Deposit Funds: Quick Deposit $500.00
$13,450.00

Bonuses:
No rakeback payments were made, however there are $20 bonus credits totaling $1400 from Jul 04 - Aug 10. There is also a $300 Biz Credit, which I don't know what that is, but assume it is some kind of affiliate payment or something.

List of all transfers:

Re: Winning Player Fergwrx WSOP package

btw the above ftp audit was originally performed by jhill3535 on ptp. credit where credit is due.

/ot

good communication by op with investors is huge here to keep it as transparent as poss. and to answer every single qn. from this point forward including all qns. about cashouts/swaps/loans/deposits/cash games/etc. and patience by investors obv. looks like will take some time to get their money.

Since he seems to not give a **** about this, maybe we should start looking into taking legal action against him. I don't know how realistic or plausible this is, but he has admitted in writing to owing X amount of money. Maybe garnished wages or something of the sort is possible, I really have no idea. Anyone with knowledge on the subject, it'd be greatly appreciated if you could chime in with some advice.

Sorry I just C&P'd it from his appeals thread on PTP, wasn't trying to claim credit for the Audit. Jhil did do it.

np bro, I have been really busy all day and meant to get over here to post as well, but never got around to it and figured it would filter over at some point anyway.

Feel free to ask me any questions about the audit here. I'll try to check in a few times a day and see whats going on here.

And he is claiming to have basically nothing, even though he did play $1000 dollar tourney with a full schedule and many $100 dollar heads ups on tuesday of this week.
This was played under wywrot just for a 1 day deal and I explained to him today what is going on.

In my experience, you can't garnish wages when he has no job.
I'm sure you could make some noise in a civil court, but again, how do you get something from nothing?
I'm not defending Ferg in any way.
I will say this, in 3 years at PTP, I've seen them recover funds when it looked like nothing was going to be done. I don't doubt them this time either.

Re: Winning Player Fergwrx WSOP package

I was roommates with Ferg (along with 3 others) in a house for the duration of the whole WSOP. So a few things...

First of all I'm as perplexed as anyone as far as what happened to the missing money. He's been in contact with me since this all came out, but he hasn't told me anything other than what's been posted and seen in the audits. When he got to Vegas (very end of May) he didn't seem to have much available cash for WSOP buyins. He explained how he'd sold action on PTP and 2p2 but all the money he'd raised was via online transfers, and his bank wire had been stuck for an absurdly long time. I can't confirm whether this was true, but I think he told me later in the series (or shortly after) that this 25k wire got returned to his account plus another 2.5k (10% for the trouble). Me and some of the other roommates loaned him some cash so he could play the earlier events while his wire was coming in. I'd guess maybe 8-10k total between us. Anyways throughout the series before his 32k WSOP cash he was very short on actual cash, and I believe on a couple occasions didn't play live tournaments because he didn't have access to the physical cash. Keep in mind that at the time none of us had any idea he was actually getting himself in a mess (I guess it's yet to be seen when this all actually started), so I at least didn't really think twice about it.

He did all the normal stuff with us throughout the summer, played some live cash, did some degenning. From what it sounded like though, he actually made money overall in non-tournament live gambling. Also I can 100% confirm that he got bronchitis while we were there, and after coughing for a week finally went to the doctor and got prescribed medicine which basically fixed it.

After he cashed for 32k he paid us back what he had borrowed, and used that money for the rest of the live buyins on the schedule, including the 10k wsop and 5k venetian mains. I haven't added things up but his claim that he boarded his plane home mid-July with no cash on him seems believable, given what I saw.

I remember him playing quite a bit of online PLO during the summer and had some pretty swingy sessions. I even watched him play a bit because I don't play PLO and was interested. He seemed to do alright in them. I do remember seeing his account balances after his 2nd-chance and 50r second-place finishes, and thinking "how does he have so little in his accounts?" I didn't ask because it wasn't really my business and I just assumed it was in his bank now or something. So I guess the point is that although he's told me none of this started until he got home from Vegas, I wouldn't be surprised if he made accounting mistakes (either intentionally or unintentionally) and was already in the hole and paying people back. I just can't see where all the money he raised and what he cashed for online would have disappeared otherwise.

Also, during our Vegas stay he was playing hyper HU sng's and seemed to do well in them but said he didn't have the bankroll to play the higher ones. I agreed to stake him 50% so he could move up, and he played quite a few of them during and after Vegas. We never closed that arrangement and I'm currently out 2k + 1.8k profit from that. I also loaned him 2k cash at the very end of the summer to play cash at Bellagio, and ended up agreeing he could just pay back online (which I never got, although I didn't ask for it until only a couple weeks ago as I'd somewhat forgotten). Finally on Aug 2nd he asked me for swap, so I sent him 2k stars but he said his FTP transfer was glitched out and wouldn't let him send. He offer to send back on stars but I told him I didn't mind waiting a day to get it as long as it was in his account. I never got that either, so I'm out a total of ~7.8k from this.

Quote:
It looks like the $7500 on Jul 05 is most likely that bootswild gave him FTP money for cash. That withdraw corresponds almost exactly with $7900 received in transfers from bootswild over the 5 hours in between. It was a direct debit so those funds should have gone to his bank account.
I believe 7 or 7.5k of this was just a straight FTP-for-stars swap, as I'd been short on stars for a while and after he won asked if I could get some. I'm fairly certain I never gave him online money for cash besides the 2k at the end of the summer.
