Looks like the McKinney room opening is delayed till next Thursday. It was originally scheduled for tonight 9/8.

Poker Rooms of Texas in Plano says that they have received a notice from the City of Plano regarding the legality of their operation. Their attorney has opened up dialogue with the city. There could be some changes to the room to ensure that they are able to continue operating.

Plano room manager told me cj's never got a license/permit from city or something. (They were in Dallas)

Looks like Poker Rooms of Texas (Plano) is closed till further notice. Out of respect to local authorities.

Though Texas might be pro-poker to some extent - It is by and large ANTI-GAMBLING (60% or more)

Well looks like the true Micheal Eakman that everyone talked about is coming out. Rumor is he is doing a JJ WATT fundraiser on Saturday for hurricane relief victims. Well according to a friend who called the foundation they have never heard of Micheal Eakman or Mint poker. So this is where the crook in him starts coming out was gonna start sooner or later. I haven't played there in about a week but I seriously doubt I will be going back.

I don't know anything on poker rooms of Texas.

I got an email yesterday from Big Texas saying they were open.

Mckinney is opening AFAIK.

Not discounting that this guy is a douchewhistle...but why exactly would he contact the foundation? He simply stated that he was giving part of the money to the foundation.

The foundation doesn't care about how you are fundraising until after the fundraising is over, then they see the money and say thanks!

The foundation doesn't care that their name is being plastered all over a potentially illegal business that is run by a known scammer? Really? Are you sure about that or are you just guessing?

Drove by the Plano room this afternoon. Handwritten CLOSED sign on door with some other language I couldn't read while driving past.

So, who has legal juristiction over these poker rooms?

State? County? City?

Bigtexas is in Richardson? Or Plano? THey are still open.
Poker Rooms of Texas is Plano, closed voluntarily.
FTN is in McKinney, and opening tonight.

Is FTN safe theoretically because they aren't in Plano?

Gambling laws are state laws are they not? I would think they all are at risk? Or at least all playing on the same playing field?

From what i understand..it is locally governed but over-ruled by state rules

So until Texas passes a comprehensive law - it is County by county

honestly it is complex...city may or may not over ride county - it depends on the jurisdiction

The gabling statues in Texas are generally state-wide, not local, not county. Any law enforcement agency with jurisdiction could take action against a given poker room. City police, county sheriff, the Constable, TABC (booze cops), highway patrol, Texas Ranger, pretty much anyone in Texas with a badge could take notice of a poker room and take action.

Jurisdiction is an issue. How the local LEOs feel about potentially unlawful card rooms matters a lot ----> so how the neighbors feel about a card room likely matters a lot too because a bunch of complaining neighbors can lead to a visit from the police.

I also note that the owners of a leased building being used for a poker room plus their agent(s) are sharing the legal risks. To the best of my knowledge this has not been an issue so far, but if the landlords start to fear legal action, this too could lead to a wave of closures.

Texas Statutes
CHAPTER 47. GAMBLING

§ 47.01. Definitions

In this chapter:

(9) "Thing of value" means any benefit, but does not include an unrecorded and immediate right of replay not exchangeable for value.

§ 47.02. Gambling

(3) plays and bets for money or other thing of value at any game played with cards, dice, balls, or any other gambling device.

§ 47.04. Keeping a Gambling Place

(a) A person commits an offense if he knowingly uses or permits another to use as a gambling place any real estate, building, room, tent, vehicle, boat, or other property whatsoever owned by him or under his control, or rents or lets any such property with a view or expectation that it be so used.

(d) It is a defense to prosecution under Subsections (a) and (c) that:

(1) the device, equipment, or paraphernalia is used for or is intended for use in gambling that is to occur entirely in a private place;

(2) a person involved in the gambling does not receive any economic benefit other than personal winnings; and

(3) except for the advantage of skill or luck, the chance of winning is the same for all participants.
