I thought the FBI referral was for public corruption. It would be nonsensical for the DA to refer the actual cases to the FBI, she would simply refer them to the state if she was going to send them anyplace. Sending the gambling cases to the FBI would be like sending them to the FDA or ICE or the IRS, I can't believe that actually happened, it just doesn't make sense unless she is intentionally trying to scuttle them.

Let me put it this way, if you were a FBI agent, which case would you choose to investigate?

1) Card rooms operating in the open that might be violating some state gambling laws.

2) Potentially corrupt government officials from the DA's office, to the mayor and up to the state AG. Deprivation of civil rights under the color of law. Inexplicably shady consulting deals & quid-pro-quo political contributions.

Again, for the card rooms, WHY THE FBI? Just kick it upstairs to the state.

The FBI referral was "Hey, I know it looks like some shady **** was happening here in my office, please come in and show that we have nothing to hide and we were the innocent victims here."

There is no state to kick it to. The DA’s office is the law enforcement representative for prosecuting state crimes. While each DA’s office is located in the county, it prosecutes state crimes.

Art. 2.07(a).  Article 2.07 states, in pertinent part,(a) Whenever an attorney for the state is disqualified to act in any case or proceeding, is absent from the county or district, or is otherwise unable to perform the duties of his office, or in any instance where there is no attorney for the state, the judge of the court in which he represents the state may appoint any competent attorney to perform the duties of the office during the absence or disqualification of the attorney for the state.․(b-1) An attorney for the state who is not disqualified to act may request the court to permit him to recuse himself in a case for good cause and upon approval by the court is disqualified.(c) If the appointed attorney is not an attorney for the state, he is qualified to perform the duties of the office for the period of absence or disqualification of the attorney for the state on filing an oath with the clerk of the court.   He shall receive compensation in the same amount and manner as an attorney appointed to represent an indigent person.Tex.Code Crim. Proc. Art. 2.07.

Interesting tidbit in the Chronicle article involving a Fertitta family member..."Zachary Fertitta, an attorney for Prime Social, said the only reason the club agreed to hire Wilson was because of Mireskandari’s connection to the district attorney’s office."

He is just a second cousin, but I still find it interesting that there is a Fertitta on both sides of the issue...

Bottom line is that there was never a viable case to be had. The SIGH idiots certainly had to have recognized that and my guess is that their 'supporters' realized they had been conned by a group that was so scared of daylight that they hid their identities...

I am not an attorney or have any legal background, but I would think that Ogg has more reasons to be concerned about an FBI and US attorney investigation than the owners of Prime or POPC.

Don’t know. Maybe she should have. Maybe her legal advisor said she couldn’t. I haven’t practiced in Houston in over 20 years so I don’t really know the politics down there now.

Alternate possibility is that the request was made via feelers and she was advised that the case lacked merit after the manner in which the case had been tainted. Certainly the AG had no interest in it...

That being said...the benches in Harris County have had some interesting views, although Kevin Fine was probably the MOST over the top idiot voters elected. So there is no telling what went on behind the behind-the-scenes scenes.

Has anyone been to this club in Bryan? Bcspoker.com? I have a friend that lives in Bryan and he was going to come to Houston this weekend but if this is legit I may go up there.

TCH is getting into the MUG scene. Jaman playing there, Neeme & Owen coming in a few weeks.
