Since a small claims case is a civil action, I don't see how it could ever be a basis to violate his probation, but I'm sure new charges would.

But, good luck trying to get Metro or the DA to bring charges against him for this WSOP house scam. I would lay 10 to 1 that they would tell the victims "we can't help you its a civil matter"

Probably not. It's a question of intent. Did he have some unforeseen financial problem, or did he intend to rip people off? With his history, and the fact that he is on probation, I believe he's going to have a problem if anyone goes to the police.

No this could easily turn into a criminal matter, especially if the victims press hard enough. I'm not familiar with how things work in Nevada or LV but committing fraud against multiple people for 15k is usually enough to get the attention of the DA's office in most places.

The fraud: It's pretty obvious that he intentionally rented out 5 rooms to 10 people, and etc.

At this point Jason has been giving me the run around all weekend saying that his "friend" will transfer half or all of the money any day now. This has not happened and Im starting to doubt it ever will. Im just wondering why he would contact all of us like this to only string us along. No money has been recieved and I doubt it will ever be repaid. To jason's friend- he is throwing your credibility under the bus along with his own.

Sorry to hear about this. If he really is stringing u guys along for the jollies, then it's truly despicable.

100% correct. If he is "in the system " already the police will happily assist you guys. The paper trail of his run around won't help him either.

What the previous poster describes is not extortion. Notifying someone if they do not live up to their legal obligations the court will be contacted is not illegal in anyway.

This is why you guys need to be more
forceful. I GUARANTEE you the judge was very clear to Jason. Any screw ups and the four year prison sentence must be served. If the court gets word that he is screwing people a few WEEKS after the case was before the court this judge will hammer Jason. Jason knows this, you need to make him aware that YOU also know this.

Earlier in this thread when it looked like he wad doing the right thing I posted that he deserves some time and much respect if he clears it up. Problems happen in peoples lives. But if he is just jerking you guys around you need to let him know the courts are going to get a detailed account of what has transpired.

eg you could legally threaten to file a civil lawsuit, but not a criminal one. But of course there are ways to achieve the same effect without openly committing extortion.

Update: I have recieved about half of the funds I am owed. I am very confident I will get the rest back too.

Sorry my friend but you are wrong on this one. Telling a person you will make the court aware of their actions is not extortion. Extortion would be if a 3rd party like me for instance contacted Jason and told him I would contact the court and detail his actions if he did not give me money. Since I am not person that Jason has harmed by Jason asking for
money to " keep quiet" would be illegal. The parties wronged by Jason have every right to share this info if the matter is not resove to their satisfaction. It is then up to probation or the judge to decide if this is a civil matter or criminal fraud. With the facts as described Jason would have been in big trouble. Remember he has 4 years in prison hanging over his head if the court feels he does anythings wrong.

I see that one of the guys posted he got paid 1/2 the
money. I am glad to see that. It would not shock me at all if Jason has been reading this thread and realized things could get much worse.

Sure they have every right to make the court aware of his actions, but they cannot ask for money to "keep quiet" for something that's clearly a criminal matter, even if they were the victims.

There has been numerous cases of alleged extortion of this nature.

Though I'm very glad (and very surprised) that he has started paying back the funds.

Donk,

We can just agree to disagree regarding the legality of this course of action. Just glad to see people are being paid back. Also I hope Jason gets his life straightened out. No one wants to see seemingly good people go through this type of stuff.

ive been paid $500 on sunday and he said the rest would come later that night as he has a rolling limit on xfers. didnt receive anything and have not heard from him since sunday.

he is clearly trying to make things right but these countless promises that he breaks is really annoying. its probably the only thing about all this that has actually pissed me off
