The Murder 3 charge is "Depraved indifference". It's used when someone fires a gun into a crowd and kills someone at random. It does not apply.
What does apply is manslaughter/murder 2.
The murder 1 charge usually requires intent. While that could apply, who knows what appeals courts decide.
If videos are all you need to understand law and intent, glad you're not a judge or lawyer. However, you are qualified to be a politician.
