Unusual 8-ball Safety Unusual 8-ball Safety

Playing a cash match the other day (bca rules, cueball fouls only) this shot came up. I played safe, and managed to get the cueball within 1mm of dead frozen between 3 balls:

Incoming player gently touched the cueball with his tip to foul intentionally. I then asked him to act as referee and remove the cueball for me, as it would be impossible for me to remove without fouling. He declined, saying it was not his responsibility.

How to proceed? We eventually just decided on a stalemate and re-rack, but that felt wrong.

IDK, tough spot but I'd say try to remove it yourself and if you bump a ball claim you bumped it with your hand and offer for him to replace it and then argue until a stalemate if you have to or purposely bump a ball out of the way with your hand and then pull the cue ball out and offer him to replace it. "cue ball fouls only"

Use some chalks as markers, remove one of the object balls, remove the cue ball and then replace the object ball as best you can agree on. It's an unusual situation that players would never think about before a game and while your opponents play was perfectly legal it is certainly against the spirit of the game - so you could play along and do what Suit suggests. Or just do what you did and re-rack - at the end of the day it depends on whether it was a friendly cash game or two guys with no respect for each other's bankroll.....
