The UIGEA did not preempt/affect State gambling laws. Nor did it make DFS any more or less "legal" than it already was. (Ironically, the UIGEA only safe-harbors payment processing for illegal internet gambling that otherwise would need or fit the exclusion. )

Read the AG Letter to FanDuel. It basically draws a distinction between traditional fantasy sports and DFS, which might answer your question.

Then google the New York Times coverage of DFS, which might provide a timing answer as well.

two questions...

1. is it basically an inevitability that all or the majority of other states will follow suit (it seems like a lot of comments imply this is the case)

2. if answer is yes, how long will DFS remain playable in its current form to > half the US?

Considering that attorney general is an elected position in many states if the move is seen as unpopular it may not happen in many states. So basically if New York goes through with the ban successfully other states will follow.

The gambling laws are also different state to state. States with less strict interpretation of gambling will likely not ban it.

It's all just guessing at this point, some can make more educated guesses than others, but really this thing can change so fast that no one really knows. In a span of 2 weeks we had the Ethan story breaking, the NV ban, several other states looking into "fixing" or banning, probably the 3rd biggest site throwing in the towel altogether and Preet riding in on his white horse to finish off the DFS beast once and for all. Pretty grim. Then 3 weeks go by with very little bad news/press. Things started to feel like they were going back to normal. Evan a miserable old **** like me was starting to think the sites were making the kind of deals they should have already had in place to end this craziness, or maybe the whole thing was just running out of steam, then BAM.


My main point being that this situation is dicey and can change in a second, but yeah, I've been thinking about what I'll do under different scenarios, so I'll play along.


Worst case scenario 12 months from now: State after state follows NY's lead, the sites lose in court, big backers pull out. We're left with little or no beatable DFS.

More reasonable WCS: Several states follow NY, Several other states attempt to "fix" DFS with ridiculous regulations (I'm talking the early PA and NJ type proposals with lotto like huge kickbacks and such, total abominations). Most/all small sites go under. After moving to where you can play you're left with smaller, less beatable games. Maybe higher rake, maybe no paypal (or CC's). Tough way to make an easy living.

Reasonable best case: Some states are gone but the games are somewhere close to what they are today in size and quality. I think DFS may have continued to grow for 3-5+ more years, with the games possibly even getting softer over the next 1-2, at least GPP's. That's gone now, imo. The games will head in the other direction, smaller and tougher. So best case this cut out a couple of the glory years.


If my state goes, and I expect it will, I'll take my time and weigh my options, but if it looks doable I will move to play, and I don't care where to. This ship is going down and I'll be goddamned if I'm not gonna be sitting on a beach somewhere with a suitcase full of cash when it's over.

Yeah it is very difficult to predict.

I tend to be pessimistic in the short-term. We had a situation where it died down for a few weeks and ignorance was bliss and we could just play. Now I think it is pretty much a ticking time bomb.

Best hope is that the leagues themselves decide they need DFS because of the increasingly competitive entertainment/viewership landscape. The leagues/big media are the special interests poker doesn't have, let's see if they can flex their muscles.

Casinos are mostly it not all govt owned in Canada. I'm not super worried about this though

That post about Florida had to be a step in the right direction though right?

They had a negative DFS wording in the law and they realized they needed a bill or it was going to be gone.

Hopefully other trouble states follow that lead.

I read a lot of posts mainly on RG comparing DFS to horse racing and casinos and the lottery...and how can they be allowed, but not DFS. They've all had their legality guaranteed in the New York State Constitution while DFS has not. So those arguments really go nowhere....unless we're talking about witnessing a movement toward a DFS constitutional amendment in New York State. That would take a while, and would still result in regulation.

I think the biggest cause for optimism is the AG's acceptance of season-long fantasy as a skill game...which he appears to do. Now it may be a matter of the sites agreeing that if we do a,b and c, then DFS could also fall into that skill game category in the opinion of the AG.

I also assume the sites will ask for an injunction to prevent a shutdown if nothing changes by Monday, but I don't know which court has jurisdiction for an injunction hearing, nor do I know which court will ultimately get to decide the case. We can always hope for a sympathetic judge I suppose. Anyway, this has the makings of an interesting legal battle.

We definitely do not want DFS to go the way of horse racing. It would absolutely kill it. The state would be able to take a tax on the initial pool. We definitely do not want that.

Got an email from DK saying they have league Hub for NBA season long where they hold $ for leagues. Seems like a very off odd transition and perhaps panick that DFS is done for but maybe they can salvage some $ by doing this??

The NFL itself has no investment in the daily fantasy sports sites nor does it have any partnership deal. No NFL team logos are used on the sites.

People fought for our freedom so we could play DFS and now the tyrannical gov't wants to take it away.

The $ they could make on something like that is an absolute drop in the bucket compared to DFS so I would have to think it is unrelated.

Unless maybe DFS gets banned and they try to stay around as a paid season long site incase DFS becomes legalized.
