No one can play while in NY. Residents of NY can still play when they are located in another state that is still allowed.

Yeah. Can't edit, though. Mentioned it earlier in the one of the league-specific threads but I noticed this when I went to New Orleans in November. Even though I submitted entries from Chicago before I left, I couldn't edit from Louisiana.

Real tough break for DK. They're running a $500k GPP for only $4. What happens to those in NY who reserved slots before the settlement? I assume DK will refund them, but the empty lineups will also likely remain registered and be dead.

Not surprising this though. Think these DFS sites might have to go through international expansion like they have done coming to the UK. But that will take time as different countries have differing regulations regarding gambling.

Always thought it is folly to argue day is night, these games are gambling pure and simple. That game of skill argument does not cut much ice, waste of time consistently arguing it like this.

Best to campaign for overhaul gambling legislation in the US, the task is made harder as each state in the US has their own varying regulations regarding gambling.

DFS is akin to making what we call an "accumulator" bet or as it is called in the US a "parlay" bet. Instead teams results or correct scores, you just pick a combination of players in a pooled betting and try win through best accumulated performance scores.

Telling articles below from NBC and Wired magazine from February. Especially the Wired magazine interview with the CEO of Draft Kings is very revealing. I am sure the New York Attorney general office read that and said good luck convincing a judge that daily fantasy is not gambling. Expect a thorough grilling from a judge compared to a less than tasking interview from a Wired journalist though.

Indeed Sir. Pool betting is gambling. Period!

Draft Kings chief international offer (CIO) Jeffrey Haas told WIRED in an exclusive interview.

You have a gambling license in the UK, so how is daily fantasy not gambling?

JH: So in 2005, the UK GC introduced a comprehensive a regulatory review of the rules and practices in the UK by which they were going to regulate all games and contests regardless of element of skill. So in order for us to operate in the UK, we have to have a license from the UKGC. So we told them about our product and they advised us that the category for our product was pool-betting. We’re operating in the UK under a pool-betting license.

Lol, laws in the UK have zero relevance to the United States. (I.e. Poker or fantasy sports could be considered gambling in one country and not the other (and you would need the license where they called it gambling.)...so saying that Draftkings needs a gambling license in the U.K. has close to zero relavence in the United States.

Gambling in the United States is done on a state by state basis. Some states may have similar gambling laws to Nevada that is why Draftkings will not get a license in Nevada but is willing to get one in the uk.

The sites tended to go with the argument that season long fantasy sports have existed for years (some for profit) with zero scrutiny legally... It's basically the fact that daily is bigger stakes and bigger profits for the sites that it gets attention.

The nfl is very hypocritical on this issue. As they promote their own fantasy games but will not do anything to aide the daily sites even though they contribute to the popularity of the sport.

I fully understand that laws differ from country to country. These daily sites were prohibited outright in certain states in the US to start with anyway. They had to explain in the term and conditions where one can play and why they are legal in the context of The Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA).

All that has happened is the states prohibiting them have grown in number since that data leak scandal came out. All that incessant obnoxious advertising could not have helped either. The trend looks to continue this way too with more bans. So we can discuss this back and forth, but it looks like they were operating in a grey area in regards to the law.

They might not be interested in Nevada due to small pool of paying customers they got from that state. The Nevada call is correct though terming it gambling and asking to operate under a license. I will not touch anything here that is not licensed, why should I ?

Before Nevada all the states on the ban list were there because of older full season fantasy sports laws already on the books, not any kind of anti-DFS effort.

You're probably right about more bans coming, but there's also a trend of real legislative effort to make DFS legal in several states.

Yahoo currently:

You are a resident of the District of Columbia or the fifty United States, except for residents of Hawaii, Louisiana, Florida, Mississippi, Montana, Iowa, Nevada, Arizona, and Washington (collectively, the “Eligibility Area”);

Speaking of Yahoo, they made some rules changes to their games:

•Strict entry limits: no more than 1% of entries per user in any contest, with a 10 entry limit
•Compete with fans: no automated entry, editing or scripts allowed
•Know your opponents: veteran players are clearly labeled

Criteria for becoming a Veteran includes:
1.Users who have entered more than 1,000 contests within a single year, or
2.Who have entered more than 250 contests and prevailed in greater than 65% of them within a single year, or
3.Who have won a single prize of $1,000 or greater more than three times within a single year.

I think these changes are good.

P.S. I do not work for Yahoo.

No, you idiot, but the commissioner of the Nfl has basically stated that he thinks daily fantasy is gambling. Meanwhile, they have tons of fantasy games on their own site and their ratings benefit from daily fantasy.

Lol, because you need some government official to tell you if a product is good or not.

If the sites present all the data from a given contest their is no need for a government official to get involved....don't believe the nonsense the number one reason the governments want to regulate is to get tax dollars not to protect anyone.

Funny you are so afraid of gambling but you are reading and posting on a poker website. Lol, evils of gambling.

yes they have a bunch of free games on their site that they will obviously promote

nfl was doing just fine before daily fantasy. regular fantasy is obviously very important

Point is season long fantasy is gambling too but the nfl loves it. Only difference is the stakes are lower and no one is making tons of money off it.

The nfl product gets worse and worse but the ratings keep going up. Gambling and fantasy sports are a big component of this phenomenon.

You are a funny person. Forum is a place for discussion and hopefully a civil one. So in this forum you have a lot of sections to discuss be it poker, fantasy sports, travel, music, movies, books etc... Just to discuss it in the right thread & section, that is all.

Would you go to a doctor that has no license ? Or borrow money from a loan shark ? License and regulations is not just taxes, it is there to so one complies to a certain professional standards.

So gamble but at least make sure you do it in a place that has certain standards. My point in short is healthy dose of scepticism and critical thinking never hurts. Gamble or play DFS with your eyes wide open and with a pinch of salt.

Let us move on. Good luck in your plays.

Most all occupational licensing requirements should be abolished. Voluntary certifications by the state or other governing bodies are fine.
