Do you have uninsured/underinsured insurance? If so, I believe that'll figure in to the equation. Either you have to sue the other guys before your insurance will pay you, or maybe they pay you and then they sue the other guys for recovery? Thankfully this is something I've never had to worry about.
I imagine your insurance will spell it out for you soon and may have some useful advice. A brief chat with a lawyer is rarely a bad idea, of course, since your insurance company is going to be looking out for themselves, not you. And because the driver isn't the owner, it gets more complicated.
