How does this make any sense? You still have the option of paying the attorney up front, even if he would have been willing to work for contingency. On the other hand, allowing for contingency payments allows people to get legal representation that couldn't afford it otherwise.

That's clearly better than those "other countries" you refer to. In economics, it's called a Pareto improvement: it's good for someone without being bad for anyone else.

I don't want to derail the thread, so just one final comment: in those "other countries" people get free quality legal representation (and health care) if they can't afford to pay for it.

Is it common for countries to provide free civil representation? In the US you can get a lawyer when facing criminal prosecution, but I've never heard of free legal rep on civil matters. Interesting, if that's the case

That is the case in some countries, including the small Northern European country where I was born.

Access to free legal representation, waiver of court fees, and waiver of possible responsibility to pay opponent's legal fees should the court ruling go against you, is decided on by court or other civil authority based on income criteria and based on the type of claim and law suit.
