I get stuck in situations like this alot, my gut feeling was that he would only call my check-raise with hands better than mine and fold all worse hands, so when he called I was assuming he had something like jacks or better....

I'd prefer to keep it small ball on the flop no need to raise

Check raise on the flop, not sure what hands you are getting to fold? Call and evaluate the turn would be ideal.
