Seems like there would have been tons of notice that this was going to happen and someone should have picked it up. At least here, I think the closing/settlement company is responsible for this I THINK too (although they don't do their searches like they should either I'm told).

There wasn't a "jr" in there or anything anywhere? Both are Bob Smith? Gotta be so confusing growing up.

Yes. Both are Bob Smith and both lived at the same address. No Jr/Sr designations anywhere.

My office handles residential real estate transactions all this time; this is literally never an issue because (1) we ask our client if they know about the judgments that a title company has picked up and (2) we then contact the attorney for the judgment creditor to determine if the judgment belongs to the property owner by verifying date of birth or ssn (3) we are especially careful when the seller has a son or daughter with the same or similar names. That never happened here.

The closing/title company is hired by the buyer and would likely argue have no duty to the seller and they are just bringing to the sellers attention potential defects in title. It is then up to the seller to have the defect omitted.

I completed the research this morning and my boss currently drafting letter refusing the demand to return the 60k; so I expect litigation to follow pretty quickly.

I imagine same here with closing company. It's just even more notice to them aside from what the atty should have known.

What's funny to me is this isn't like a $10 judgment. It's $60k that just slipped Dad's mind that perhaps he should be aware of. I mean maybe he doesn't know (even though they live in the same house etc) but how does he not say hey just checking, my son with the same name etc etc.

Have any of you had professors that ban laptops from class? I find it infuriating. One of my 1L professors did, so I had no choice. But now my 2L professor has decided to announce that he's implementing this policy 5 days before class starts. No thank you.

How old are we again? It's a professional school, graded on a curve, and uber expensive. I learn best with a computer and multiple documents open. I write slowly and it would be a major time sink.

i think this is a legitimate gripe. would have been really bad for me to ban laptops. i have horrible handwriting and handwrite really slow, while i type extremely fast.

also i wouldnt be able to gchat with my friends in class about the gunners so what's the point of showing up really

Had one do it last semester; she relented to student pressure by like October. Have another one who has same policy this semester.

Does not bother me that much, when it came to studying for finals last semester I barely referred back to class notes.

Yeah or I would make my outlines from my handwritten notes, not that hard. Personally I found it better for retention to hand write notes, doesn't feel "real" on the computer. Probably 80% of the class used laptops even my 1L year. I knew that when I brought in my laptop I wasn't focusing/it was distracting etc. You think you're paying attention but you're really not. Had multiple people who switched to handwriting tell me they did much much better that way.

anyone have any tips on negotiating bar prep courses this late 3L year?

i have heard the rumors that you get way better deals late and i ended up getting a decent deal last week (1500 or so for BARBRI when they are pretending like 1900 was the public interest discount and it was the best you were gonna get 3 months ago) but pretty sure i can do better. afaict there isn't even a physical class component anymore so unless i'm missing something i'm pretty sure every single person they sign up is basically 100% pure profit and i am the one with all the leverage in the world as they could sign me up for 100 bucks the day before the course starts and still be better off

the only thing that makes me second guess this is in case the BARBRI people have strict orders from up above to not give in to this late semester leverage stuff in order to discourage kids in future years from doing the same. of course i suspect this is what they will tell me but it i'm not sure how much to believe it. it's kind of hard not to be like bitch you just sent me an email 3 months ago saying that 2200 was the best price we were gonna get for the rest of the year i can't really take your word for anything

am i missing something? if it matters at all my state has a ridiculously high bar passage rate too so i'm pretty sure worst case scenario i could buy the books and self study without missing too much. i am pretty lazy though so i think the course structure would be helpful for me
