Feel for you, but your story doesn't seem to have much credibility.

If you were under the limit and it's on record, how could they charge you unless they had probable cause that you were a threat on the road, ie: swerving in and out of lanes, mumbling during interrogation, ect.. As you've stated, none of these things occurred, so It's his word against yours, and his word sticks. If your dead set on reasoning that your calves were injured you could go to your doctor and get documented evidence of this.

Every other cop at the station sided with you and suggested you should be released..

Bottom line, your lawyer will cost more than the fine. Pay up and never drink and drive again.

Unless you've ever spent time in NJ, you wouldn't know how dishonest the police are. The fact that I was given a ticket for "improper turn through checkpoint" illustrates this. I turned down my friend's street, which had a cop car parked on the opposite direction. I was easily able to make the legal right turn, but I just know that the cops are going to somehow argue that the entire street was blocked off. Additionally, the validity of one's injury claim doesn't matter. They're supposed to offer an alternative field sobriety test when one claims that they have an injury preventing them from taking the test. My calves ARE permanently jacked up from running and sprinting for the last 15 years, but I've also had an inner-ear balancing issue my entire life. I wasn't able to walk until I was almost two years old, and I have medical records to prove this. Did the cop ask if I had medical conditions other than injuries? Nope.

It definitely sounds like I'm whining about the police, and to some I may sound irresponsible. I just don't see a problem with drinking and then driving while under the legal limit if one feels sober enough to do so.

You sound guilty to me. Seems like you like to straddle the line legal/overlimit.

And you got caught.

Re: Beat: Got a DWI in NJ. What to do?

1. The best thing you have done so far
2. Whatever....if he thought you were avoiding the stop because you were drunk, that is probable cause.
3. This is actually in your favor about your calves, check the police report and see if it is in there. If your lawyer is any good, he will use this.
4. Some states will arrest you for .07

Honestly, the case sounds pretty weak, and if you lawyer is worth his salt, he should get this reduced or found innocent.

Seriously, stop crying about how dishonest the police are. It's nothing but juvenile whining and comes off as pathetic. You can take it to bank that I've probably spent 20x as much in my life as most people have on traffic tickets, and you know what? Every single one of them was my own fault. I drove like an idiot when I was younger, and had to pay the price. Btw, this includes NJ, since I'm there often due to living in SINY.

You drank, you drove, it's your fault. Bottom line.

The calf thing is something I've never heard of, and I was on the track team in HS.

Exactly how does sprinting **** up your calfs enough so that you can't do a field sobriety test?

As Chad Norman would say, "Good for you."

2. The cop didn't have probable cause to pull me over. I pulled down my friend's street, who I was going to visit. There was a police checkpoint 50 ft farther down the road, and was pulled over because I turned down my friend's street. The cop could possibly lie and say that the street was blocked off.

Yeah, just a coincidence that your friend just happened to live a few feet down from the checkpoint, and just a coincidence that you just picked the time of the checkpoint to go visit your friend, and just a coincidence that you just happened to be drinking that night before driving on a checkpoint night, and it couldn't have possibly been because you were petrified of failing a breath test.

3. The cop conducted a standard field sobriety test even though I told him that my calves were injured and that I couldn't perform the test. This is the reason that I was arrested. Again, the cop could lie about this with impunity.

Yeah, more coincidences on top of coincidences. What are the chances that your "calves were injured" just when you happened to be asked to perform a SFST. How conveeeeeenient. Yeah, while you're at it, tell the officer that you didn't know about the laws on DWI because your eyes were injured and thus not able to read about them to be informed of these laws. That would actually be more believable.

Did you have a wheelchair or disabled placard? Did you dance at the club? Did you walk to the refrigerator to get a beer then walk back? Did you walk up to a bar? But oh NOW that Officer Friendly is putting you to the test, your *calves hurt* WAHHHHH

4. I passed the breathalyzer at 0.07. Everybody else at the police station suggested releasing me, except for the cop. DWI laws are bull****. There should be limits for a reason. They shouldn't be able to charge you when you're below the limit.

After wasting the officer's time with all your B.S. crybaby can't walk and trying to dodge the roadblock with some B.S. about visiting a friend, by the time you get taken to the station you blow a .07. Well guess what, that means you were a .08 or better when you got behind the wheel. Unless you drank in the back of the squad car, in which case I stand corrected. Oh wait, I can't stand corrected--my calves hurt.

You probably left out that you blew a PBT at .08 or more at the scene. But that couldn't POSSIBLY be an accurate reading. Good thing for you the courts don't admit those as evidence of your guilt. But they sure do count for probable cause. And you were drunk as a skunk by NJ law. Behind the wheel. You know, those DWI laws you call "bull****." The ones that save lives. That keep morons like you from turning their addiction that normally only destroys your own brain cells (have at it, here's another shot--or I can drive you to AA, whichever you prefer)...oh no, you gotta IMPOSE your HORRIBLE VALUE CHOICES ON OTHERS by ARROGANTLY getting behind the wheel of a 2-ton chunk of metal and fly down the road with severely impaired mental faculties.

So what do you do, you ask? WHAT DO YOU DO? I'll tell you what you do. You stop ****ing drinking, because you obviously can't control your alcohol or you wouldn't have risked the lives of the public by driving on the road after drinking to the point of intoxication. Here's what else you can do: Stop making excuses and get help. And another thing. Please stop driving until you've completed the 12 steps and are in long term recovery. You're dangerous.

Be glad you didn't murder anyone.

Is there anything else that I could be doing to assist in my defense? My first court date is 6/13.

Yeah, get help, quit drinking, agree to a bracelet with breath testing every few hours as condition of bail, go to counseling and participate fully...commit to never drink again, tell the judge you were wrong to get behind the wheel, ask him to dismiss because you learned your lesson and the official result was below the legal limit. Or plead guilty, accept the probation as something that will only help you, and move on with your life.
Long story short: Excuseaments
