Seems like the correct course of action is:
lawyer -> defense (they over served you, you have a clean record and just were drunk as hell) -> get money from the bar in a civil suit afterward.

There is no other report. I went back to the police department to see if they had not given me the entire report. I went there and they couldn't help me as the lady who handles this had already left. I want to know what they are saying I stole! I certainly was not doing anything other than looking for a bathroom. I honestly feel her story is partly fabricated as this is just not the person I am. I clearly was looking for a bathroom... My friend who was there said that I left saying "i'm going to the bathroom". The next thing he sees is me being escorted out.

This whole thing is crazy. How can they say I was stealing? In the report it says that a woman saw me go up there and knew I shouldn't be in that area. I'm sure she immediately followed me. The first person who confronted me was a woman. She was very mad at me. This is the one moment of clarity that I have. It's almost like when she yelled at me, it kind of triggered some consciousness.

I had a meeting with my bondsman today, and he said that it is weird that they did not breathalyze me. He also said that this might work against me in the long run. I'm not sure about his reasoning behind that, I'm just relaying what was told to me.

This is a big charge guys. They were holding me on a HUGE bond. All that I'm guilty of is drinking too much, too quickly. Then going into an area I thought had a bathroom. Then in a moment of stupidity I blacked out and pee'd. That is seriously all that I did.

I do not have much money to spend on a lawyer, but I do have a full-time job @ $13/hour. If I can get on a payment plan I will be able to hire an attorney.

I know I'm rambling... this whole situation has taken a big toll on me this week.

I wanted to thank everyone again for your responses. Many of you put some nice thought into them and I really appreciate it. THANK YOU VERY MUCH.
Do you remember peeing? If not, you will have a hard time convincing the judge that you didn't steal anything. How would you remember if you did or not?

I believe you when you say that you are not the type of person to steal, but are you the type of person to pee on the floor at a bar? Alcohol can make you do some f'ed up things.

grunch but to be convicted of burglary you have to have specific intent to go into someone's home and steal something. intoxication can negate that. not legal advice, obv contact a lawyer

I just got back from talking to a lawyer. His fees are based on the charge. Those fees range from $7500 to $15000. He said he'll do it for the bottom end.

$7500

He said there is a good chance we can get it all erased, based on them over serving me.

I don't know if I should roll the dice and get a public defender which I may qualify for. Or if I should just make some moves and get the money.

Does anyone here have any advice for me in this regard? I do not want to get stuck with a felony. I feel that is very unlikely, but with a public defender I just don't know. The prosecutor will most likely try to bully them.

I don't know what to do guys....

PDs are usually pretty competent. I would meet with one, see if you qualify, see if they make you feel comfortable, and if not, pay the attorney.

Always pay for a good attorney, I got hosed by a public defender when I was 19. Getterdone36 got in tons of trouble 16 years ago and the 10k I paid the attorney was a bargain. Pay up now and suck it up, it will pay dividends for years to come.

You have to qualify for a PD? I thought you were entitled to one.

I think there are income restrictions, but I could be mistaken. Never done criminal law.
