Wasn't there legal issues with bank of timex, what is different between pokershares ('official bank of timex') vs the old bank of timex?

edit/

oh as I was typing this I heard in the video they are only operating under euros as payments so I assume that is a way to bypass certain laws / issues

PokerShares is fully licensed and as a result operates by the same rules as a typical sportsbook/poker site

wasn't the point of this to have a second side of the market for selling action. will that be incorporated at some point?

Do you have permission from all the pros to use their names/likeness on your site for profit? I can't imagine these pros would allow you to do this. I hope you have solid lawyers in place, because doing this is obviously going to hurt the pros since they will have a harder time selling action, it will also hurt the tournament organizers/prize pools since less pros will be able to enter tournaments without selling action, and it will hurt the industry as a whole, IF this takes off. Any poker pro who wants this to do well is clearly not seeing the bigger picture. Hope you have considered these things, good luck!

Pros could still sell action, they'd just have to sell at a lower markup than Poker Shares is offering.

The claim of trademark infringement with regards to the selling of shares is in a grey zone. The question is whether usage of players names to sell pieces of action is more like trying to sell shirts with the players face without their permission, or if it's merely like offering sports bets as many sites do.

Of course pros can still sell their action and they will on other sites such as 2+2 etc, but if pokershares is using the names/likeness of pros such as Daniel Negreanu without their consent then this will not fly. Daniel is in no way benefiting from having pokershares allow people to "bet" on him, which is the difference between Daniel choosing to sell some of his own real action, and a gambling site allowing you to buy imaginary shares. As stated before, this is going to hurt pros from being able to sell action, it will hurt the tournament scene, and it will also hurt the industry as a whole. The only one benefiting from this would be pokershares if it were to last. If the pros are smart they will ban together and not allow their names or likeness to be used for profit without their consent.

heartsofpalm you're assuming trademark infringement and damages, and all I said was that they're not as clear cut cases as you are making them out to be.

Although to be honest, trademark infringement should probably be a concern. Which is unfortunate when excessive mark ups are rampant, and this site offers better deals to consumers. It might be safer for Timex to just offer sports betting, like the Cate Hall vs Mike Dentale match up which looks good

Do you have permission to use D.N.'s name in your post?

Timex isn't claiming the participants in the events covered endorse the site.

Hi stakekings owner.

Love the concept of this won't be difficult to undercut every stakekings/youstake ripoff package.

Problem is even undercutting everyone your still offering -ev packages from a buyers standpoint so why would anyone savvy spend a cent?

Well they'll at least be capturing those buyers who don't think or don't care that the packages have been -EV, right? To them, this is a better deal regardless. Plus they'll capture new buyers who like the prices the site offers.

Is the SK link suspicion or confirmed? If so MOD should confirm.

Interesting questions raised about viability of selling stakes though being reduced by this alternative action on offer. I presume PS can't list any action until an entrant is confirmed so stake offer from the player would have to be a pre-requisit, but it's sure to make people think twice if they think they can get a better price by betting rather than staking.

Regarding right to use peoples names, think it's a non-issue in this respect. My only worry is how much bet-fixing could take place in the future as this would offer a guaranteed profitability option for players to throw their game having bet against themselves.

So rather than using the 2p2 forums to stake someone in the PCA 5K$ Main Event, I can just use this site and pay 120 to get a percent of "request any player" at markup of 2.4? That will kill off the people selling at 2.5 and above, but has nothing to do with the main staking market.

The main sell seems to be the chance to take a piece of players like Fedor Holz or Daniel Negreanu and have a sweat which is not otherwise available to the general public.

Bookies offer action on racehorses which are later scratched all the time. It's of key importance whether the terms say the bet is voided or if it's settled as a loser, but there's nothing to stop them offering it in advance.

That's right. European bookies running books on the US election didn't license the names of Clinton and Trump in order to do it.
