Why Can't Pokerstars Re-Enter the US Market Containment Thread

Terms of an agreement with the DOJ? Because if the wire act doesn't apply to poker the UIGEA isn't a problem for them, right? What am I missing?

UIGEA still applies because offering online poker would break every state's laws.

they signed a deal with doj saying they wouldn't offer real money play to anyone in the US until the legal proceedings are over. they signed that to get their domains back from doj a couple days after BF.

doj would bring the hammer down on them for breaking such a deal

Not every state's laws, but definitely many state laws.

Further, even if Stars executives pleaded out or convinced the DoJ to dismiss the charges against them, they are FAR from out of the legal woods in this country. Bear in mind they offered online poker in 50 states and the District of Columbia without a gaming license. If they started up again in the US, they'd face significant exposure to state prosecutions.

Pokerstars offering real money play in the US is still in violation of the UIGEA, which is an entirely seperate piece of legislation than the wire act.

Read the BF indictments. Count how many times the Wire Act is mentioned. Maybe after this exercise you will see why.

Without the Wire Act, there is no federal law making Ipoker illegal. The Feds can only enforce the UIGEA+IGBA if a poker site is in violation of a state law. There are states where one could make the case that IPoker doesn't violate any laws. Absent the DoJ deal, Pokerstars could, hypothetically, operate legally in those states.

It would not be a profitable venture in their eyes otherwise they would serve the US regardless of any stupid law(s).
