A valid patent can serve as a means to obtain revenue from a market in which the holder has no operating or supplier license.

It also can serve as a sword against other similar products in a market, including the US market.

Even IF PStars has not obtained a gaming license, it can collect licensing fees for anyone it can claim uses the patented process/product in that party's licensed or unlicensed poker operations.

Royalties claims do not require a Nevada gaming license, nor that the gaming even be legal. Ask First Technologies or BoDog.

Effectively, depending upon the validity or status of the patent, PStars is buying a share of anything like "Rush poker" for the US market, without having to get any gaming license itself.

That's what I thought as well, if the patent is enforceable, PS will virtually own casino (slot) style i-poker, but patent lawyers have said that the process is so obvious that the patent may be worthless.

I saw a bunch of quotes from the CEO of Instapoker saying that lawyers told him, "X". That is not very authoritative. I am interested in the current status, if known, of the Rush Poker patent application at the USPTO.

(I have represented online sites against patent infringement claims. Of course a patent lawyer with a client with an interest in launching a similar product will offer some statement arguing against the enforceability of a patent against his client's potentially alleged infringement. This situation, as far as I know, does not even involve any actual issued US patent, aside from the "provisional patent" cited by FTP. Given the reported rejection of the Rush application, that threshold issue of status is what I am hoping someone here might pin down or already know)

I'm interested as well, also we don't even know how long FTP/PS has the rights to the pending patent.

There was quite a bit of discussion about this issue after BF, when the value of FTP was being debated, and the prevailing theme from software patent experts was that the goal of fast fold poker was so obvious, and the code used to reach that goal so standard, that it wouldn't hold.

The little I know about patent law makes me think the opposite, Apple, Microsoft, Samsung, Motorola etc frequently get judgements for the most obvious of patented software features (app store?), and if fast fold poker was so simple, why did it take everyone else so long to copy it?

This question is for Donkey Q or others in the loop with regards to the Nevada online poker stuff, what is the best place to find updates on the issuance of licenses for NV online poker sites and the targeted dates they might be up and running?

Also, if you could give a quick summary of where things stand at this moment. As best I can tell it appears that South Point is projected to have a site up by the end of 2012 and that is the only specific site I have heard about. Who do you think will be #2, #3, #4, etc. and when do you anticipate those sites going live (also if you had to guess how many licenses (sites) will there be in total in the next 18 months?)

Looks like the casinos plan to use internet poker as a gateway to getting people into their casinos. It's already being done at the free play site from the Golden nugget.

South Point Casino Snags First Nevada Operator Approval For Internet Poker

The company said it has “unique, patent-pending” technology for geo-location — a key issue for an intrastate market to work. For example, neighboring Utah has banned the game.

The company also highlighted the fact that it will allow online poker cash deposits and withdraws at its in-person cage. The company said it’s “very excited and proud to have built a home-grown product — launching this fall, maybe.”

After the Nevada Gaming Commission gives the final OK later this month and awards the license, technology inspection will need to be completed. The company said Wednesday that it has finished its “preliminary review” with a third-party lab. The company added that it’s just a week away from entering its second and final review.
