There is a hearing on the Commonwealth's Motion to Dismiss the case scheduled for April 1. This hearing is primarily about technical legal issues regarding the ability to bring such a case. If the Motion is denied, then the case proceeds to a full hearing on the merits of the claim.

The hearing was delayed by the court at the last minute. I will post the new date as soon as we have it.

The case is Daniels v. Mobley, #CL-10-2538 in the Circuit Court for City of Portsmouth, VA.

Last news I had was the hearing on the motion to dismiss the case would occur 5/18/11.

Barry Taylor, Esq. of Virginia Beach is representing Mr. Daniels (with assistance from the PPA).

PS - stop yelling. Courts are slow, deal with it.
